SECOND READING <br />5/2/11. <br />ORDINANCE N0. 20-11 BY: 4~cs@i~~xs~;;;.~5x~=l~vr)k„I ;Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members of Council otherwise, it shall take effect and be in <br />force after the earliest period allowed by law, enacting new Section 111.13, Sale <br />Through Trade-In, of the Codified Ordinances of the City of Lakewood, authorizing <br />Director of Finance to sell, through trade-in various obsolete vehicles, mac~ery and/or <br />equipment having estimated values in excess of scrap value for the purchase of <br />replacement/new vehicles, machinery and/or equipment. <br />WHEREAS, it is in the best interest of the City to sell through trade-in various <br />obsolete vehicles, machinery and/or equipment to apply toward purchase costs of new <br />vehicles, machinery and/or equipment, and; <br />WHEREAS, trade-in values often exceed the value that would be received <br />through the current process of sale which requires an auction or the scrap value of the <br />item; and <br />WHEREAS, it is fitting that the City of Lakewood obtain the best value for <br />obsolete vehicles, machinery and/or equipment to offset the cost of purchasing <br />replacement items; and <br />WHEREAS, currently, the Administration is required to obtain approval of Council <br />each and every time that a sale through trade-in is negotiated; and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines <br />that this ordinance is an emergency measure, and that this ordinance shall take effect <br />at the earliest date possible as set fprth in ARTICLE TII, SECTIONS 10 and 13 of the <br />SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary to <br />provide for the usual daily operation of municipal departments in that it is in the best <br />interest of the City to sell, through trade-in in a tjmely manner to achieve best pricing <br />for purchase of new vehicles, machinery and/or equipment. Now therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. That new section 111.13, Sale Through Trade-In, of the Codified <br />Ordinances of the City of Lakewood is hereby enacted to read as follows: <br />111.13 SALE THROUGH TRADE-IN <br />The Director of Finance is hereby authorized to approve the sale of any excess or <br />obsolete vehicles, machinery and/or equipment through trade-in to offset the purchase <br />
