529.10 POSSESSION, SALE OR CONSUMPTION ON PUBLIC PROPERTY. <br />(a) No person shall take any beer or intoxicating liquor into or upon any <br />municipal properly, park, public building, bath house, public school properly or other place <br />where the public is permitted to assemble. <br />(b) No person shall sell, give away or drink any beer or intoxicating liquor upon <br />any street, avenue, public highway or public grounds within the City. <br />(c) This section shall not apply if any beer or intoxicating liquor is being sold or <br />on public properly in accordance to a Special Event Permit issued pursuant to Chapter 557, <br />Parades and Special Events, or within the public right-of-way pursuant to a Conditional Use <br />Permit for Outdoor Dining issued under the authority of Section 1161.03(t), provided, <br />however, such activity shall meet all other applicable laws and regulations for the <br />possession, sale and consumption of beer or intoxicating liquor. <br />Section 2. This ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety and <br />welfare in the City and for the usual daily operation of the City for the reasons set forth <br />and defined in the preamble to this ordinance, and provided it receives the affirmative <br />vote of at least five (5) of members of Council, this ordinance shall take effect and be in <br />force immediately upon its adoption by the Council and approval by the Mayor otherwise, it <br />shall take effect and be in force after the earliest period allowed by law. <br />Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open meeting <br />of this Council, and that all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the public in compliance with <br />all legal requirements. <br />Adopted: 2v 2v <br />Approved: ~ off, <br />P E DENT <br />CLERK <br />MAYOR <br />
