Please <br />substitute for the original. <br />ORDINANCE NO. 24-11 BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members of Council, or otherwise to take effect and be in force <br />after the earliest period allowed by law, amending Chapter 557, Parades and Special <br />Events, of the Codified Ordinances of the City of Lakewood in order to allow special <br />events to be held within the public right-of--way, in addition to Lakewood Parks, and to <br />allow the Director of Public Safety to consider whether or not alcohol will be served at an <br />event one of the determining factors in issuing a permit. <br />WHEREAS, in 2008 Council adopted legislation that permitted the use of city- <br />owned park property for use by community groups as defined by the ordinance for events <br />such as fundraisers and other community events which are not sponsored by the City of <br />Lakewood; and <br />WHEREAS, since that time, the administration has received requests for the use <br />of the public right-of--way for similar events and has realized that some of these events <br />are already occurring within the City of Lakewood; and <br />WHEREAS, these events, when held in a manner that ensures the public safety <br />and protection of residents and public and private property, can be an asset to our <br />community; and <br />WHEREAS, Council currently is considering legislation that, if adopted, would <br />allow alcohol to be served on City property in conjunction with a special event permit; <br />and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines <br />that this ordinance is an emergency measure, and that this ordinance shall take effect at <br />the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the <br />SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and to <br />provide for the usual daily operation of municipal departments in that the use of the <br />public right-of--way for events should be made available to community groups for events <br />held this season; now, therefore, <br />
