No person shall operate an existing wood- <br />fired boiler between the dates of May 1 and October 30, ex- <br />cept that this provision shall not apply on days when the out- <br />door air temperature is below fifty (50) degrees Fahrenheit or <br />when operation is necessary to prevent a safety or health <br />emergency. Notwithstanding the date or outdoor temperature, <br />no person shall operate an existing wood-feed boiler on any <br />day on which the Air Quality Index in Lakewood, as deter- <br />mined by the Northeast Ohio Areawide Coordinating Agency, <br />is forecasted as unhealthy, very unhealthy or hazazdous. <br />(5) Nuisance conditions. The emission or escape of air contami- <br />nants into open air from any wood-fired boiler in such a man- <br />ner or in such amounts as to endanger or tend to endanger the <br />health, comfort, safety or welfare of the public, or that is rea- <br />sonably offensive and objectionable to the public, or that shall <br />cause unreasonable injury or damage to the property or inter- <br />fere with the comfortable enjoyment of property or normal <br />conduct of business, is hereby found and declared a public <br />nuisance. No person shall cause, permit or maintain any such <br />public nuisance using awood-fired boiler. <br />(f) Enforcement. <br />(1) The Director of Public Safety or his or her designee shall have <br />the power to enforce the provisions of this section. <br />(2) The City may issue such orders as aze necessary to aid in the <br />enforcement of the provisions of this section. These orders <br />may include, but shall not be limited to orders requiring per- <br />sons to cease the use of wood-fired boilers in violation of any <br />provision of this ordinance; orders to take corrective action or <br />to abate a public nuisance regardless of whether the operation <br />of the wood-fired boilers is otherwise in conformity herewith; <br />or orders requiring production of information. Such orders <br />may also include requirements that the stack height be ex- <br />tended higher than the peak of any residence located within a <br />certain distance from the stack; that a catalytic converter be in- <br />
