Placed on 1st reading and referred <br />to the Planning Commission 9/19/11, <br />2"d reading 10/3/11; amended ver- <br />sion recommended for adoption by <br />Planning Commission 12/1/11; please <br />substitute for original. <br />Referred to_the Committee of the Wtrole 12/19/11 <br />ORDINANCE N0.43-11 <br />BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE to amend the Zoning Code of the City of Lakewood for the purpose of <br />establishing a conditional use for drive-tluough facilities in the City. <br />WHEREAS, the current level of development in the City requires continued review of <br />best practices to protect residential neighborhoods abutting commercial zones; and <br />WHEREAS, in July 2011 Councilmember Anderson introduced a communication to <br />Council asking the Planning Director and the Planning Commission to undertake a review of the <br />current code as it pertains to drive-through uses; and <br />WHEREAS, the results of that review and a comprehensive inventory of all existing <br />drive-through facilities were presented at a public work session with the Planning Commission <br />this past August; and <br />WHEREAS, it has been determined from a review of the code and an inventory of exist- <br />ing conditions that the Zoning Code does not sufficiently address drive-through uses in manner <br />that promotes best practices vis-a-vis residential neighborhoods; and <br />WHEREAS, the Lakewood Community Vision calls for a zoning code that enables <br />commercial and residential land uses to successfully coexist; and <br />WHEREAS, the Lakewood Community Vision calls for a zoning code that addresses <br />land use impacts of automotive uses and the protection of neighborhood character; and <br />WHEREAS, studies authored by the Institute of Transportation Engineers offer data per- <br />taining to haffic volumes and stacking distances and requirements support a revision to the Zon- <br />ing Code; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power to enact laws that are for the health, safety, welfare, comfort <br />and peace of the citizens of the municipality; now, therefore <br />BE IT ORDAINED BY THE CITY Oh`L~1IfEWOOD, STATE OF OHIO: <br />Section 1.
