<br />1302.08 CONFLICT.
<br />(a) Whenever a provision of the Ohio Basic Building Code, as adopted in
<br />Section 1302.01, conflicts with a provision of the Oleo Fire Code or any other
<br />order, standard or rule of the Ohio Department of Commerce, Division of State
<br />Fire Marshal, the rules of the Ohio Board of Building Standards shall supersede
<br />and govern any order, standard, or rule of the division of laborer the department
<br />of commerce, division of the state fire marshal, the department of health, and of
<br />counties and townships, in all cases where such orders, standards, or rules are in
<br />conflict with the rules of the board, except that rules adopted and orders issued
<br />by the state fire marshal pursuant to Chapter 3743. of the Revised Code prevail

<br />1302.99 PENALTY.
<br />Whoever violates atry provision of this chapter or any Code adopted Herein or
<br />fails to comply with any lawful order issued pursuant thereto is guilty of a
<br />misdemeanor of the first degree and shall be fined not more than one thousand
<br />doltaxs ($1,000) or hnprisoned not more than six mouths or both. Each day
<br />during which nmrcompliauce or a violation continues shall constitute a separate
<br />offense. The City may institute injunction proceedings in Common Pleas Court
<br />to abate the nuisance of failure to cease work after receipt of a stop work order
<br />as referred to in Seetien-1-382:86(b) the Ohio Building Code.
<br />Section 2. It is found and determined that all formal actions of this Council concerning
<br />and relating to the passage of this ordinance were adopted in an open meeting of this Council,
