PLACED ON 1ST READING & REFERRED TO THE <br />HOUSING COMMITTEE 12/19/11. <br />PLACED ON 2,112 READING 1/3/12. <br />ORDINANCE NO. 67-11 BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powes, Smith. <br />AN ORDINANCE repealing Chapter 1304, National Electrical Code, to be consistent <br />with the City of Lakewood's state certification and current Ohio law. <br />WHEREAS, the City of Lakewood is certified to enforce the Residential Code of Ohio; <br />and <br />WHEREAS, the City is certified to enforce the Ohio Building Code; and <br />WHEREAS, the most current versions of National Electrical Code are already adopted by <br />reference in both the Residential Code of Ohio and the Ohio Building Code; and <br />WHEREAS, Chapter 1304 currently incorrectly references the 1999 National Electrical <br />Code; and <br />WHEREAS, Chapter 1304 is in conflict with Ohio law and the City's state certification; <br />and <br />WHEREAS, the City may by its legislation exercise all powers of local self-government <br />and adopt and enforce within its limits such local police, sanitary and similar regulations as are <br />not in conflict with general laws; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Chapter 1304, currently reading as follows: <br />CHAPTER 1304 <br />National Electrical Code <br />1304.01 PURPOSE AND ADOPTION. <br />Pursuant to the provisions of Ohio R.C. 731.231, the National Electrical Code, <br />being particularly the 1999 edition thereof, designated NASllNFPA No. 70- <br />1999, is hereby adopted by the City and incorporated by reference as a part of <br />the Building Code of the Ciry of Lakewood as if fully set out herein, except such <br />provisions as are, hereinafter amended, enacted or deleted. The propose of a <br />National Electrical Code as adopted herein is the practical safeguarding of <br />persons, buildings and dwellings, and their contents from hazards arising from <br />the use of elechicity for heat, light and power and for other purposes. <br />1304.02 FILE AND DISTRIBUTION COPIES. <br />A complete copy of the National Electrical Code as adopted herein is on file <br />with the Clerk of Council and the Buildurg Commissioner for inspection by the <br />public, and a copy is also on file in the Cuyahoga County Law Library. The <br />Clerk of Council has copies available for distribution to the public at cost. <br />
