Placed on first reading and referred to <br />the Public Safety Committee 2/6/12, <br />second reading 2/21/12; please substi- <br />tute for original. <br />ORDINANCE NO. 2-12 BY: Anderson, Bullock, .Turfs, <br />Madigan, Nolwin, Powers. <br />AN ORDINANCE amending Section 506.04 of the Codified Ordinances, Excep- <br />tion, Registration and Fee, for the purpose of permitting temporary exceptions to the pro- <br />hibition of pit bull dogs and canary dogs benefiting licensed veterinarians and animal <br />hospitals and chatitable animal rescue organizations. <br />WHEREAS, Chapter 506 of the Codified Ordinances, Dangerous and Vicious <br />Animals, generally prohibits the harboring or keeping of pit bull dogs and canary dogs in <br />the City; and <br />WHEREAS, after Chapter 506 was substantially altered with the passage of Ordi- <br />nance 58-08, adopted July 21, 2008, questions have arisen as to whether pit bull dogs and <br />canary dogs may be kept by veterinarians, animal hospitals and animal rescue organiza- <br />tions in the City, even if on a temporary basis; and <br />WHEREAS, a 60-day exception from the ban favoring licensed veterinarians and <br />animal hospitals and charitable animal rescue organizations furthers the spirit and intent <br />of Ordinance 58-08 and adequately protects the public; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re- <br />vised Code, municipalities have the power to enact laws that are for the health, safety, <br />welfare, comfort and peace of the citizens of the municipality; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. That Section 506.04 of the Codified Ordinances, Exception, Registra- <br />tion and Fee, currently reading as follows: <br />506.04 EXCEPTION, REGISTRATION AND PEE. <br />(a) Any owner of a dangerous animal as defined in Section 506.03 <br />on the effective date of this section who iutends to keep such <br />dangerous animal within the City of Lakewood shall have <br />nnnety days from the effective date of this section, or, on a <br />showing of good cause for having failed to adhere to the pro- <br />visions hereof within ninety days of the effective date of this <br />section, thirty days from the date the owner is notified of his <br />or her noncompliance, to register such dangerous animal with <br />the Director of Public Safety or his or her desiguee. The fee <br />for such registration shall be fifty dollars ($50.00). Registra- <br />tion shall take place annually thereafter. Registration shall in- <br />
