and that it is necessary for the immediate preservation of the public property, health, and safety <br />and to provide for the usual daily operation of municipal departments in that the City wishes to <br />close any window of time between the effective date of the state code change and the effective <br />date of the local code change; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. Section 517.05, Cheating, of the Codified Ordinances of the City of Lake- <br />wood, currently reading as follows: <br />517.05 CHEATING. <br />(a) No person, with purpose to defraud or knowing that he is facilitating a <br />fraud, shall engage in conduct designed to convpt the outcome of: <br />(1) The subject of a bet; <br />(2) A contest of knowledge, skill, speed, strength or endurance; <br />(3) A scheme or game of chance. <br />(b) Whoever violates this section is guilty of cheating, a misdemeanor of <br />the first degree, if the potential gain from cheating is less than three <br />hundred dollars ($300.00), or if [he offender has not previously been <br />convicted of any gambling offense or of any theft offense as defined in <br />Section 545.01. <br />shall be and hereby is amended to read as follows: <br />517.05 CHEATING. <br />(b) Whoever violates this section is guilty of cheating, a misdemeanor of <br />the first degree, if the potential gain from cheating is less than three <br />hundred one thousand dollars ($39001 000.00), or if the offender has <br />not previously been convicted of any gambling offense or of any then <br />offense as definednr Section 545.01. <br />Section 2. Section 525.02, Falsification, of the Codified Ordinances of the City of Lake- <br />wood, currently reading as follows: <br />525.02 FALSIFICATION. <br />(a) No person shall knowingly make a false statement or knowingly swear <br />or affirm the truth of a false statement previously made, when any of the <br />following applies: <br />(1) The statement is made in any official proceeding. <br />(2) The statement is made withpurpose to incriminate another. <br />
