(c) No person, with purpose to violate this section, shall receive, possess, <br />control or dispose of a credit card. <br />(d) Whoever violates any of the provisions of this section is guilty of mis- <br />use of credit cards, a misdemeanor of the first degree, provided that the <br />cumulative retail value of the property and services involved in one or <br />more violations, involving one or more credit cards and occurrhtg <br />within a period of ninety days, is less than five hundred dollars <br />($500.00). <br />shall be and hereby is amended to read as follows: <br />545.10 MISUSE OF CREDIT CARDS. <br />(d) Whoever violates any of the provisions of this section is guilty of mis- <br />use of credit cards, a misdemeanor of the first degree, provided that the <br />cumulative retail value of the property and services involved in one or <br />more violations, involving one or more credit cards and occurring <br />within a period of ninety days, is less than €tvo-hundred one thousand <br />dollars ($309.901,000.00). <br />Section 8. Section 545.14, Tampering with Records, of the Codified Ordinances of the <br />City of Lakewood, currently reading as follows: <br />545.14 TAMPERING WITH RECORDS. <br />(a) No person, knowing he has no privilege to do so, and with purpose to <br />defraud or knowing that he is facilitating a fraud, shall do any of the fol- <br />lowing: <br />(1) Falsify, destroy, remove, conceal, alter, deface or mutilate any writing <br />or record; <br />(2) Utter any writing or record, knowing it to have been tampered with as <br />provided in subsection (a)(1) hereof. <br />(b) Whoever violates this section is guilty of tampering with records, a mis- <br />demeanor of the fnst degree. If the violation involves data or computer <br />sofivare the value of which or loss to the victim is five hundred dollars <br />($500.00) or more, or if the writing or record is a will umevoked at the <br />time of the offense, tamperhg with records is a felony and shall be <br />prosecuted under appropriate State law. <br />shall be and hereby is amended to read as follows: <br />545.14 TAMPERING WITH RECORDS. <br />(b) Whoever violates this section is guilty of tampering with records, a <br />
