In case of failure to ~av any char eg s duly prescribed, the Ciry may take any appropriate action against a recipient of water service or property owner including but not limited to instituting any proceeding in a court of proper jurisdiction, shutting off service in accordance with Section 902.09 and certifying the amount of all wild water service char eg s to the Cuyahoga County Auditor, with interest accming at a rate of ten percent (10%) per annum from thirty days after the date of delinquency, agahrst the lot or parcel of land involved. Such assessments shall be so certified to the County Auditor and shall be collected and reimbursed to the Ciry in the same manner as special assessments. Section 4. It is found and detenrtined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 5. This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the pre-amble to this ordinance, and provided it receives the affirmative vote of at least five (5) members of Council this ordinance shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor, or othertivise shall take effect and be in force after the earli- estperiod allowed bylaw.
