PLACED ON 1ST READING & REFERRED TO THE PUBLIC <br />SAFETY COMMITTEE 2/6/12. <br />PLACED ON 2ND READING 2/21/12. <br />ORDINANCE NO. 1~-f~ BY: Bullock, Juris, Madigan, Nowlin, <br />Powers, Smith. <br />AN ORDINANCE amending Section 905.02, Hours Open to the Public, to allow the <br />Director of Public Works to control park hours by season and events in an effort to curtail <br />vandalism. <br />WHEREAS, the City desires to keep its parks open and available to its residents and <br />friends without sacrificing safety and cleanliness; and <br />WHEREAS, Lakewood is committed to providing our respectful and responsible citizens <br />with the highest quality parks possible; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power to enact laws that are for the health, safety, welfare, comfort <br />and peace of the citizens of the municipality; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. That Section 905.02, Hours Open to the Public, of the Codified Ordinances of <br />the City of Lakewood, currently reading as follows: <br />905.02 HOURS OPEN TO PUBLIC. <br />(a) Parks shall be open daily for use by the general public <br />(b) Except as provided in subsection (d) hereof, no person other than anon-duty <br />employee of the City shall enter into or remain within the limits of <br />Lakewood Park, Madison Park or Kaufman Park between the hours of 11:00 <br />p.m. and sunrise. <br />(c) No person other than an on-duty employee of the City shall enter into or <br />remain within the limits of Webb Park, Wagar Park, Edwards Park or Cove <br />Park during the time fiom one hour after sunset to sunrise. <br />(d) No person, other than an on-duty employee of the City, shall enter into or <br />remain within that area of Lakewood Park, north of the existing most <br />northerly fence line between the hours of 11:00 p.m. and 6:00 a.m. of the <br />following day, and at such times as the Director of Public Works deems it <br />necessary due to special events and{or weather conditions. Special <br />permission may be granted, in writing, by the Director of Public Safety or <br />the Director of Public Works, to persons to use this area. <br />shall be and is hereby amended to read as follows: <br />905.02 HOURS OPEN TO PUBLIC. <br />
