PLACEll ON iST READING & REFERRED TO THE <br />FINANCE COMMITTEE 5/7/12. <br />ORDINANCE NO. 29-12 BY: Anderson, Bullock, Surfs, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect inunediatel}+ provided it receives the affirmative vote of <br />at least five (5) members of Council, or othert~+ise to take effect at the earliest period allowed by <br />law, amending Section 1775.01, Weed, Tall Grass, Nuisance Vegetation or Growths over Side- <br />walks; Removal, of the Codified Ordinances of the City of Lakewood for the purpose of <br />strengthening the procedures involving collection of fees related to the City's abatement of nui- <br />sances related to tall weeds and grass. <br />WHEREAS, Section 1775.01 of the Codified Ordinances sets out procedures and respon- <br />sibilities.regardiug the payment and collection of fees related to the City's abatement of ntti- <br />sauces stemming fi•om tall weeds and grass on private property; and <br />WHEREAS, that section stands to be updated and augmented in order to clarify the rights <br />and obligations of persons subject to the City's abatement of tail weed and grass nuisances; and <br />WHEREAS, that section stands to be updated and angmented in order to clarify the City's <br />rights and obligations with respect to the collection of nuisance fees; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits mu- <br />nicipalities to exercise all powers of local self-government and to adopt and enforce is+ithin their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines that this <br />ordinance is an emergency measure and that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood <br />and that it is necessary for the immediate preservation of the public property, health, and safety <br />and to provide for the usual daily operation of municipal departments in that the City wishes to <br />ensure updated rights and obligations go into effect prior to the next billing cycle(s); now, there- <br />fore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 1775.01, Weed, Tall Grass, Nuisance Vegetation or Growths over <br />Sidewalks; Removal, of the Codified Ordinances of the City of Lakewood currently reading as <br />follows: <br />1775.01 WEED, TALL CRASS, NUISANCE VEGETATION OR <br />G120WTHS OVER SIDEWALI{S; REMOVAL. <br />(a) The owner, occupant or person having the charge or management of any <br />lot or parcel of land situated within the City, whether the same be improved <br />
