Placed on first reading and re- <br />ferred to Rules and Ordinances <br />Committee 5-21-12; second reading <br />6-9-12; please substitute for the <br />original. <br />ORDINANCE NO. 30-12 <br />BY~Anderson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect inunediately provided it receives the affirmative vote of <br />at least five (5) members of Council, or otherwise to take effect at the earliest period allowed by <br />law, submitting to the electors of the City of Lakewood an amendment to the Second Amended <br />Charter of the City of Lakewood in order to create consistency within Cuyahoga County related <br />to filing deadlines for those standing for election to municipal offices. <br />WHEREAS, Article XVIII, Section 9 of the Ohio Constitution permits City Council the <br />authority to submit proposed amendments to the Charter to the electors of the City by a two- <br />thirds vote of Council; and <br />WHEREAS, Article XXIII, Section 6 of the Charter permits City Council the authority to <br />submit proposed amendments to the Charter to the electors of the City by atwo-thirds vote of <br />Council; and <br />WHEREAS, it is the intention of Council to place before the electors of the City a charter <br />amendment which, if adopted, would create consistency within Cuyahoga County related to fil- <br />ing deadlines for declarations of candidacy for municipal offices, and thus contribute to cost sav- <br />ings and time efficiencies in the operation of elections inodd-numbered years; and <br />WHEREAS, the Cuyahoga County Board of Elections has requested this change across <br />municipalities within the county based on 2010 state code amendments passed by the General <br />Assembly requiring that absentee ballots be sent to servieemembers and overseas civilians earlier <br />than was previously required; and <br />WHEREAS, Article XIX, Section 6 of the Charter thus stands to be amended in order to <br />fulfill the intention of Council; and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines that this <br />ordinance is an emergency measure, and that the ordinance shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City <br />of Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health and safety, and to provide for the usual daily operation of municipal departments in that <br />the deadline for submission of municipal charter amendments to the Cuyahoga County Board of <br />Elections is Friday, September 7, 2012; now, therefore <br />
