PLACED ON FIRST READING & _. <br />REFERRED TO THE PUBLIC SAFETY <br />COMMITTEE 10/15/12. <br />PLACED ON SECOND READING 11/5/12. <br />ORDINANCE NO. 51-12 BZ'~ Anderson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five (5) members of Council, or otherwise to take effect at the earliest period allowed by <br />law, amending Section 303.041, Emergency, Public Safety and Coroner's Vehicles Exempt, of <br />the Codified Ordinances of the City of Lakewood for the purpose of complying with changes to <br />the State of Ohio traffic code. <br />WHEREAS, Ohio Revised Code Section 4511.15 was repealed on Apri120, 2012; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits nnr <br />nicipalities to exercise all powers of local self-government and to adopt and enforce within their <br />limits such as local police, sanitar}= and other regulations as are not in conflict with general laws; <br />and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines that this <br />ordinance is an emergency measure and that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood <br />and that it is necessar}= for the immediate preservation of the public propert}=, health, and safety <br />and to provide for the usual daily operation of municipal departments in that the City wishes to <br />close any window of time between the effective date of the state code change and the effective <br />date of the local code change; now, therefore, <br />BE IT ORDAINED BY'I'HE CffY OF LAKEWOOD, STATE OP OHIO: <br />SECTION 1. Section 303.041, Intersections, Emergency, Public Safety and Coroner's <br />Vehicles Exempt, currently reading as follows: <br />303.041 EMERGENCY, PUBLIC SAFETY AND CORONER'S VEHICLES <br />F_XEMPT. <br />(a) Ohio R.C. 4511.12, 4511.13, 4511.131, 4511.132, 4511.14, 4511.15, <br />4511.202, 4511.21, 4511.211, 4511.22, 4511.23, 4511.25, 4511.26, 4511.27, <br />4511.28, 4511.29, 4511.30, 4511.31, 4511.32, 4511.33, 4511.34, 4511.35, <br />4511.36, 4511.37, 4511.38, 4511.39, 4511.40, 4511.41, 4511.42, 45] 1.43, <br />4511.431, 4511.432, 4511.44, 4511.441, 4511.57, 4511.58, 4511.59, 4511.60, <br />4511.61, 4511.62, 4511.66, 4511.68, 4511.681 and 4511.69 and all sections of <br />this Traffic Code or other municipal ordinances that are substantially equivalent to <br />the sections listed above, do not apply to the driver of an emergency vehicle or <br />public safety vehicle if the emergency vehicle or public safety vehicle is respond- <br />ing to au emergency call, is equipped with and displaying at least one flashing, ro- <br />
