PLACED ON SST READING & <br />REFERRED TO THE PUBLIC <br />SAFETY COMMITTEE 10/15/12. <br />PLACED ON 2ND READING 11/5/12. <br />ORDINANCE NO. 52_12 BY: Anderson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five (5) members of Council, or otherwise to take effect at the earliest period allowed by <br />law, amending Section 313.03, Traffic Control Signal Terms and Lights, and 313.05, Pedestrian <br />Control Signals, of the Codified Ordinances of the City of Lakewood for the purpose of comply- <br />ing with changes to the State of Ohio traffic code. <br />WHEREAS, the following changes have recently been made to the State of Ohio traffic <br />code; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits mu- <br />nicipalities to exercise all powers of local self-government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as ace not in conflict with general laws; <br />and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines that this <br />ordinance is an emergency measure and that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood <br />and that it is necessary for the immediate preservation of the public property, health, and safety <br />and to provide for the usual daily operation of municipal departments in that the City wishes to <br />close any window of time between the effective date of the state code change and the effective <br />date of the local code change; now, therefore, <br />BE IT ORDAINED BY TIIE CITY OF LAKEWOOD, STATE OF OHIO: <br />SEC"PION 1. Section 313.03, Traffic Control Signal Tertns and Lights, currently reading <br />as follows: <br />313.03 TRAFFIC CONTROL SIGNAL TERMS AND LIGHTS. <br />Whenever h•affic is controlled by traffic control signals exhibiting different <br />colored lights, or colored lighted arrows, successively one at a time or in combina- <br />tion, only the colors green, red and yellow shall be used except for special pedes- <br />trian signals carrying words or symbols. The lights shall indicate and apply to <br />drivers of vehicles and to pedestrians as follows: <br />(a) Green Indication: <br />(1) Vehicular traffic facing a circular green signal may proceed straight <br />through or turn right or left unless a sign at such place prohtbrts either such <br />turn. But vehicular traffic, including vehicles turning right or left, shall <br />yield the right of wad to other vehicles and pedestrians lawfully within the <br />urterseetion or an adjacent crosswalk at the time such signal is exhibited. <br />(2) Vehicular traffic facing a green arrow signal, shown alone or in <br />combination with another indication, may cautiously enter the intersection <br />
