(e) <br />n'~'~02.The court shall not impose a license suspension for <br />a first violation of this section or if more than three years have passed <br />since the offender's last violatimt of Ohio R.C. 4510.12 or a substan- <br />tially equivalent municipal ordinance. <br />If the offender was convicted of or pleaded guilty to one or more viola- <br />tions of Ohio R.C. 4510.12 or a substantially equivalent municipal ordi- <br />nance within the past three years, and if the offender's license was expired <br />for more than six months at the time of the offense, the court shall impose <br />a class seven suspension of the offender's driver's license, commercial <br />driver's license, temporary instruction permit, probationary license, or non- <br />resident operating privilege from the range specified in division (A)(7) of <br />Ohio R.C. 4510.02. (ORC 4510.12) <br />SECTION 2. Section 335.02 Permitting Operation Without a Valid License, currently <br />reading as follows: <br />335.02 PERMITTING OPERATION WITHOUT VALID LICENSE; ONE LI- <br />CENSE PERMI`I'fED. <br />(a) No person shall permit the operation of a motor vehicle upon any public or <br />private property used by the public for purposes of vehicular travel or <br />parking knowing the operator does not have a valid driver's license issued <br />to the operator by the Registrat• of Motor Vehicles under Ohio R.C. Chap- <br />ter 4507 or a valid commercial driver's license issued under Ohio R.C. <br />Chapter 4506. <br />(b) No person shall receive a driver's license, or a motorcycle operator's en- <br />dorsement of a driver's or commercial driver's license, unless and until he <br />surrenders to the Registrar all valid licenses issued to him by another ju- <br />risdiction recognized by the State of Ohio. No person shall be permitted to <br />have more than one valid license at any time. (ORC 4507.02) <br />(c) (1) Whoever violates subsection (a) hereof is guilty of an unclassified <br />misdemeanor. The offender may be fined up to one thousand dol- <br />lats ($1,000) and pursuant to Ohio R.C. 2929.27(B) additionally <br />may be ordered to serve a term of community service of up to five <br />hundred hout•s. If the offender previously was convicted of or <br />pleaded guilty to two or more violations of this section, Ohio R.C. <br />4507.02 or a substantially equivalent municipal ordinance within <br />the past three years, the offense is a misdemeanor of the first de- <br />gree. <br />(2) Whoever violates subsection (b) hereof is guilty of a misdemeanor <br />of the first degree.(ORC 4507.02; 4507.99; Ord. 36-10.
