given to the owner or person in control of the property and give the loca- <br />tion of the accident and a description of the damage insofar as it is known. <br />(b) Whoever violates subsection (a) of this section is guilty of failure to stop <br />after an accident involving the property of others, a misdemeanor of the <br />first degree. <br />The offender shall provide the court with proof of fiuanciat re- <br />sponsibility as defined in Ohio R.C. 4509.01. If the offender fails to <br />provide that proof of financial responsibility, then, in addition to any <br />other penalties provided by law, the court may order restitution pur- <br />suant to Ohio R.C. 2929.28 in an amount not exceeding five thousand <br />dollars ($5,000) for any economic loss arising from an accident or col- <br />lisimt that was the direct and proximate result of the offender's opera- <br />tion of the motor vehicle hefore, during or after committing the of- <br />fense charged under this sectimt. (ORC 4549.03) <br />SECTION 'l. R is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, <br />and that atl such deliberations of this Council and of any of its couunittees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />SECTION 8. This ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined iu the pre-amble <br />to this ordinance, and provided it receives the affirmative vote of at least five (5) members of <br />Council this ordinance shall take effect and be in force immediatel}~ upon its adoption by the <br />Council and approval by the Mayor, or otherwise shall take effect and he in force after the earli- <br />est period allowed by law. <br />Adopted: ~'(/l3wc?++-~c.=.. ~, `J-u('~ <br />U <br />Approved: 2 ~ ~ ~ <br /> <br />PRESIDENT <br />
