PLACED ON 1ST READING & <br />REFERRED TO THE PUBLIC SAFETY <br />CONAIITTEE 10/15/12. <br />SECOND READING 11/5/12. <br />ORDINANCE NO. 59-12 BY: Anderson, Bullock, Juris, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect innnediately provided it receives the affirmative vote of <br />at least (ive (5) members of Council, or otherwise to take effect at the earliest period allowed b}+ <br />law, enacting Section 335.074, Driving Under License Forfeiture or Child Support Suspension, <br />of the Codified Ordinances of the City of Lakewood to create a new offense in the traffic code. <br />WHEREAS, Rev. Code § 4510.111 bas been enacted by the General Assembly to pro- <br />hibitdriving ~~+hile under a license forfeiture or child support suspension; and <br />WHEREAS, the "Traffic Code within Codified Ordinances, which generally mirrors the <br />state traffic code, stands to be augmented with the creation of similar traffic offenses within the <br />City; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits nnr <br />nicipalities to exercise all powers of local self-government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as ue not in conflict with general laws; <br />and <br />WHEREAS, this Council by a vote of at least five (5) of its members determines that this <br />ordinance is an emergency measure and that it shall take effect at the earliest date possible as set <br />forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood <br />and that it is necessary for the immediate preservation of the public property, health, and safety <br />and to provide for the usual daily operation of municipal departments in that the City wishes to <br />close any window of time behveen the effective date of the state code change and the effective <br />date of the local code change; now, therefore, <br />6E I'f ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />SECTION I. Section 335.074, Driving Under License Forfeiture or Child Support Sus- <br />pension, sha(1 be hereby enacted as follows: <br />335.074 DRIVING UNDER LICF_NSE FORFEITURE OR CIIILD SUPPORT <br />Sl1SPENSION. <br />(a) No person shall operate any motor vehicle upon a high~~+ay or any public <br />or private property used by the public fa• purposes of vehicular travel or <br />parking in this Municipality whose driver's or commercial driver's license <br />has been suspended pursuant to Ohio R.C. 4510.22 for failing to appear iri <br />court or to pay a tine, resulting in license forfeiture. <br />(b) No person shall operate any motor vehicle upon a highway or any public <br />or private property used by the public for purposes of vehicular travel or <br />parking in this Municipality whose driver's or commercial driver's license <br />has been suspended pursuant to Ohio R.C. 3123.58 for being in default in <br />
