In all cases, if the vehicle is registered in the offender's <br />name and if, within three years of the offense, the offender <br />previously has been convicted of or pleaded guilty to hvo <br />violations of division (A) or (B) of Ohio R.C. 4510.ll 1, or <br />auy canbination of two violations of division (A) or (B) of <br />Ohio R.C. 4510.1 I 1 or Ohio R.C. 4510.1 l or 4510.16, or a <br />substantially equivalent numicipal ordinance, the court, in <br />addition to any other sentence that it imposes upon the of- <br />fender, ma}}~ order the immobilization of the vehicle in- <br />volved iu the offense for sixty days and the impoundment <br />of that vehicle's license plates for silty days i~i accordance <br />with Ohio R.C. 4503.233. <br />C. Iu all cases, if the vehicle is registered in the offender's <br />name and if, within three years of the offense, the offender <br />previously has been convicted of or pleaded guilty to three <br />or more violations of Ohio R.C. 4510.111 or any eonr~ina- <br />tion of three or more violations of Ohio R.C. 4510.111 or <br />Ohio R.C. 4510.11 or 4510.16 or a substantially similar <br />umuicipal ordinance, the court, in addition to any other seu- <br />teuce that it imposes upon the offender, may order the <br />criminal forfeiture of the vehicle involved in the offense to <br />the State. <br />(e) An order for immobilization and impoundment under this section shall be <br />issued and enforced under Ohio R.C. 4503.233 and 4507.02, as applicable. <br />"I'he court shall not release a motor vehicle from immobilization ordered <br />under this section unless the court is presented with current proof of finan- <br />cial responsibility with respect to that motor vehicle. <br />(f) An order for criminal forfeiture under this section shall be issued and en- <br />forced under Ohio R.C. 4503.234. Upon receipt of a copy of the order <br />from the court, neither the Registrar of Motor Vehicles nor a Deputy Reg- <br />istrar shall accept any application fw• the registration or transfer of regis- <br />tration of any nrota• vehicle owned or leased by the person named iu the <br />declaration of forfeiture. The period of registration denial shall be five <br />years after the date of the order, unless, during that period, the court hav- <br />lirgjurisdiction of flee offense that led to the order terminates the forfeiture <br />and notifies the Registrar of the termination. "fhe Registrar then shall take <br />the necessary measures to permit the person to register a vehicle owned or <br />leased by the person or to transfer registration of the vehicle. (ORC <br />4510.111). <br />SUCTION 2. It is found and determined that all formal actiwrs of this Council concernhig <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of auy of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />S1;CTION 3. This ordinance is hereby declared to be an emergency treasure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the pre-amble <br />to this ordinance, and provided it receives the affirmative vote of at least five (5) members of <br />Council this ordinance shall take effect and be in force immediately upon its adoption by the <br />Council and appro~~al by the Niayor, or otherwise shall take effect and be in force after the earli- <br />est period allowed by law. <br />
