Drive a commercial motor <br />vehicle in violation of any provisimt of Ohio R.C. 4511.61 to 4511.63 <br />or any federal or local la~ti• or ordinance pertaining to railroad- <br />highway grade crossings <br />(13) Use a motor vehicle in the commission of a felony involving the manu- <br />facture, distribution, or dispensing of a controlled substance as de- <br />fined in Ohio R.C. 3719.01 or the possession with intent to manufac- <br />ture, distribute, or dispense a conhrolled substance. <br />(b) Whoever violates this section is guilty of a misdemeanor of the first degree. <br />(ORC 4506.15) <br />SECTION 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in au open meeting of this Council, <br />and that all such deliberations of this Council and of any of its conunittees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />SECTION 4. This ordinance is hereby declared to be an emergency measure necessary for <br />the inunediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the pre-amble <br />to this ordinance, and provided it receives the affirmative vote of at least five (5) members of <br />Council this ordinance shall take effect and be in force immediately upon its adoption by the <br />Council and approval by the Mayor, or otherwise shall take effect and be in force after the earli- <br />est period allowed by law. <br />Adopted: ~r/1r.ac•..~ac, ~`~ '~~'0`} <br />_. <br />Approved: " / ~-+~ ~ /~ ZJ ~ L. <br />.J- ~- <br />PRESIDENT <br />MAYOR <br />
