Drive a commercial motor vehicle in violation of any provisimt of Ohio R.C. 4511.61 to 4511.63 or any federal or local la~ti• or ordinance pertaining to railroad- highway grade crossings (13) Use a motor vehicle in the commission of a felony involving the manu- facture, distribution, or dispensing of a controlled substance as de- fined in Ohio R.C. 3719.01 or the possession with intent to manufac- ture, distribute, or dispense a conhrolled substance. (b) Whoever violates this section is guilty of a misdemeanor of the first degree. (ORC 4506.15) SECTION 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in au open meeting of this Council, and that all such deliberations of this Council and of any of its conunittees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 4. This ordinance is hereby declared to be an emergency measure necessary for the inunediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the pre-amble to this ordinance, and provided it receives the affirmative vote of at least five (5) members of Council this ordinance shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor, or otherwise shall take effect and be in force after the earli- est period allowed by law.
