PLACED ON 1ST READING & REFERRED TO <br />THE FINANCE COMMITTEE 11/19/12. <br />SECOND READING 12/3/12. <br />ORDINANCE NO. 72-12 BY' Andreson, Bullock, Juris, Madigan, <br />Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect inunediately provided it receives the affirmative vote of <br />at least five (5) metnbers of Council, or otherwise to take effect and be in force after the earliest <br />period allowed by law, to amend section 915.01, Establishment of Rates, of the Codified <br />Ordinances of the City of Lakewood for the purpose of adjusting water rates charged against each <br />lot, parcel of land or premises which may have an active water connection with the Municipal <br />water system. <br />WHEREAS, sufficient revenues are required to recover costs budgeted for the operations <br />of the Water Distribution System; and <br />WHEREAS, continued decreases in consumption of water has a negative impact on <br />revenues received over time; and <br />WHEREAS, sufficient dollars are required to meet scheduled debt service payments; and <br />WHEREAS, in order to offset the increases in the purchased water from the City of <br />Cleveland to the City as well as the continuing increases in the costs of operations, it is necessary <br />for the City to increase the rates charged; and <br />WHEREAS, this Council by a vote of at least five (5) of its metnbers determines that this <br />ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the <br />City of Lakewood, and that it is necessary for the immediate preservation of the public peace, <br />property, health and safety, and to provide for the usual daily operation of municipal departments <br />in that in that these rates and charges must be in place for the 2013 fiscal year. Now therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO <br />Section 1. That section 915.01, Establishment of Rates, of the Codified Ordinances of <br />the City of Lakewood currently reads as follows: <br />915.01 ESTABLISHMENT OF RATES <br />The Director of Phrance is hereby authorized and directed to establish water rates charged <br />monthly by the Division of Utility Billing as follows: <br />(a) The Director of Finance is hereby authorized and directed to establish water <br />rates charged monthly by [he City as follows: <br />Effective January 1, 2012, all water used during each one month billing period <br />shall cost not more than five and ninety-three hundredths dollars ($5.93) per one <br />hundred cubic feet of water. <br />(b) hr case of failure to pay any charges duly prescribed, the Ciry may take any <br />appropriate action against a recipient of water service or property owner, <br />
