filed they shall be inquired into before the commencement of the proposed improvements and the <br />Director of Law shall be and is hereby authorized and directed to institute legal proceedings in a <br />court of competent jurisdiction to inquire into any claims so filed. <br />Section 5. The cost of said improvement to be assessed shall be assessed in the manner <br />and the number of installments provided in the Resolution and on the lots and lands abutting and <br />abounding upon said improvement between and including the termini of the improvement as ap- <br />proved by the Board in its report, and the cost of said improvements shall include the cost of pre- <br />liminary and other surveys, plans, specifications, profiles and estimates and of printing, serving <br />and publishing notices, resolutions and ordinances the amount thereon; the costs incurred in con- <br />nection with the preparation, levy and collection of the special assessments; the cost of purchas- <br />ing, appropriating and otherwise acquiring therefor any required real estate or interests therein; <br />expenses of legal services, including obtaining any approved legal opinions; the cost of labor and <br />material, together with all other necessary expenditures. <br />Section 6. The City having received bids for the completion of the work since the report <br />of the Board, the list of estimated assessments as heretofore prepared by the Director of Finance <br />and as approved by the Board in its report be and the same is hereby modified to reflect that the <br />total assessment amount shall be changed from $1,831.00 to $1,878.00 per property, and the as- <br />sessments so to be levied shall be paid in 20 semiannual installments, provided that the owner of <br />any property to be assessed may at his option pay such assessment in cash within 30 days of <br />completion of the improvement. <br />Section 7. Pursuant to Article XVI, Section 16 of the Charter of the City, the Director of <br />Public Works has certified to this Council that this estimate of the life of the improvement de- <br />scribed herein is 20 years. <br />Section 8. The Director of Public Works be and he is hereby authorized and directed as <br />soon as the funds hereof are available to make and execute a contract for materials and certain <br />services with the lowest and best bidder after advertising according to law. <br />Section 9. The Clerk of this Council be and she is hereby directed to deliver to the Fiscal <br />Officer of Cuyahoga County a certified copy of this ordinance within 15 days following its pas- <br />sage. <br />Section 10. It is found that the improvements to be made pursuant to this ordinance have <br />been petitioned for in writing by the owners of a majority of the foot frontage to be assessed. <br />Section 11. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council and <br />that all such deliberations of this Council and of any of its committees that resulted in such for- <br />mal action were in meetings open to the public in compliance with all legal requirements. <br />Section 12. This ordinance is hereby declared to be an emergency measure for the rea- <br />sons stated in the preamble hereof, and provided it receives the affirmative vote of at least five <br />members of Council it shall take effect and be in force immediately upon its adoption and ap- <br />
