PLACED ON 1ST READING & REFERRED TO <br />THE RULES' . &.;ORAINANOW;�CP3;COMMITTEE 5/19/14. <br />REPORTED OUT;ON i,PLACED.ON_:2nd READING 6 /2/14. <br />ORDINANCE NO. 25 -14 BY: Bullock,,Juris, Madigan, Marx, <br />Nowlin, O'Leary. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect at the earliest period allowed by law, <br />to amend Section 144.03, Qualifications for Applicants for Fire Department, within the Adminis- <br />trative Code of the City of Lakewood to increase the maximum age for a firefighter at hire to 40 <br />years old. <br />WHEREAS, it is necessary and desirable to amend the Administrative Code of the City <br />to increase the maximum age for entry or lateral -entry firefighters; and <br />WHEREAS, the Ohio Revised Code has increased the maximum age for the hiring of <br />firefighters under state civil service rules to age 40; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power of local self - government, and the power to enact laws that <br />are for the health, safety, welfare, comfort and peace of the citizens of the municipality; and <br />WHEREAS, this Council by a vote of at least five of its members determines that this or- <br />dinance is an emergency measure and that it shall take effect immediately, as set forth in Article <br />III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments, in that the current eligible list for the po- <br />sition of firefighter expires very soon; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 144.03, Qualifications for Applicants for Fire Department, of the Cod- <br />ified Ordinances of the City of Lakewood, currently reading as follows: <br />144.03 QUALIFICATIONS FOR APPLICANTS FOR FIRE DEPART- <br />MENT. <br />(a) All applicants for entry level uniformed positions for Fire must be at least <br />twenty -one (2 1) years of age at the time of appointment, and no person shall <br />be eligible to receive an original appointment on and/or after the person's <br />thirty -first (31 ") birthday. <br />(b) Subsection (a) hereof is specifically intended to supersede State Code pro- <br />visions on the age of applicants for appointment to positions in the Fire De- <br />partment. <br />is hereby amended to read as follows: <br />
