The following fees must be deposited with the City of Lakewood Building De- <br />partment prior to the commencement of soil disturbing activities: <br />(a) Abbreviated SWP3 <br />$75.00 <br />(1) Review /Inspection Reserve <br />$750.00 <br />Fee* <br />65.00 <br />(2) Control Performance Bond ** <br />1,500.00 <br />(b) Comprehensive SWP3 <br />(1) Review/Inspection Reserve <br />750.00 <br />Fee* (per disturbed whole acre, <br />Example: 1.25 <br />Acre disturbance = $1500) <br />(2) Erosion Control Performance <br />1,500.00 <br />Bond ** <br />(per disturbed whole acre) <br />* to be posted at time of SWP3 submittal <br />** to be posted at time applicable permits are issued. <br />(c) Funds shall be withdrawn from the Review/Inspection Reserve at the fol- <br />lowing hourly rates for any work completed by representatives of the City Engi- <br />neer related to the review, inspection and enforcement of full and abbreviated <br />SWP3s (assessed in 1 /2 -hr. increments): <br />(1) City Engineer <br />$75.00 <br />(2) Construction Site Inspections <br />65.00 <br />(3) Project Engineer <br />65.00 <br />(4) Engineering Technician <br />50.00 <br />1339.99 PENALTIES. <br />(a) No person shall violate, or cause, or knowingly permit to be violated, any of <br />the provisions of this chapter, or fail to comply with any such provisions or with <br />any lawful requirements of any public authority made pursuant to this chapter, <br />or knowingly use or cause or permit the use of any lands in violation of this <br />chapter or in violation of any permit granted under this chapter. <br />(b) Whoever violates or fails to comply with any provision of this regulation is <br />guilty of a misdemeanor of the first degree and shall be fused no more than one <br />thousand dollars ($1,000.00) or imprisoned for no more than one hundred eighty <br />(180) days, or both, for each offense. <br />(c) A separate offense shall be deemed committed each day during or on which <br />a violation or noncompliance occurs or continues. <br />(d) Upon notice from the City Engineer, or designated representative, that a <br />project site does not meet the requirements of this chapter, such work shall im- <br />mediately stop. Such notice shall be in writing and shall be either hand - delivered <br />or sent by certified mail, return receipt requested, to the owner or person respon- <br />sible for the development area, or person performing the work, and shall state <br />26 <br />
