PLACED ON 1ST & REFERRED TO THE PUBLIC <br />WORKS COMMITTEE 6/16/14. <br />VLACED ON 2ND READING 7/7/14. <br />Tree Trunk Flare Zone Appropriate Care LCO 565.04 amendment <br />ORDINANCENO. 11 -14 BY: Anderson, Bullock, Juris, <br />Madigan, Marx, Nowlin, O'Leary. <br />AN ORDINANCE amending Section 565.01, Definitions, and Section 565.04, Placing <br />Harmful Substances Near Trees, of the Codified Ordinances of the City of Lakewood to prohibit <br />actions harmful to the tree trunk flare zone. <br />WHEREAS, healthy, mature, and safe trees are beneficial to property values, air quality, <br />storm water management, energy use reduction, and the beautification of our City; and <br />WHEREAS, the trunk flare zone is critical to the growth, development, and long term <br />health of a tree, and appropriate care for the trunk flare zones of public trees, by prolonging their <br />lives, will conserve taxpayer dollars and help the City achieve its goal of attaining a robust, <br />consistent tree canopy; and <br />WHEREAS, the Lakewood Tree Task Force recommended tree management policy <br />changes to this effect; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self - government and to adopt and enforce within <br />their limits such as local police, sanitary and other regulations as are not in conflict with general <br />laws; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 2. Section 565.01, Definitions, of the Codified Ordinances of the City of <br />Lakewood, currently reading as follows: <br />565.01 DEFINITIONS. <br />The following words, whenever referred to in this chapter, are defined as follows: <br />(a) 'Public place" means any public street, public highway, public park or any <br />property owned or held by the City, within the boundaries of the City. <br />(b) "Tree" means any tree. <br />(c) "Arboriculture" or "tree preservation" means and includes the treating, <br />spraying, pruning, maintaining and any other care or work intended for the strengthening <br />of trees, and the removal and prevention of tree pests, blights and diseases of any and all <br />kinds. <br />(d) 'Director of Public Works" or "Director" means the Director of Public Works <br />of the City. <br />(e) "City" means the City of Lakewood, Ohio. <br />
