Please substitute for <br />the original. <br />ORDINANCE NO. 34 -14 BY: Anderson, Bullock, Suris, <br />Madigan, Marx, Nowlin, O'Leary. <br />AN ORDINANCE repealing Chapter 737, Pawnbrokers, and replacing it with <br />Chapter 737, Secondhand Dealers, of the Codified Ordinances of the City of Lakewood, <br />in order to discard outmoded provisions and institute timely regulations within the Code. <br />WHEREAS, Chapter 737 of the Code, which governs pawnbrokers and dates in <br />part to 1961, no longer applies to any businesses operating in the City; and <br />WHEREAS, Chapter 737 does not regulate secondhand dealers; and <br />WHEREAS, it is important that during police investigations the secondhand deal- <br />ers comply with the Ohio Revised Code Section 4737.01, as well as the local regulations, <br />by maintaining records necessary to identify the seller of any stolen items; and <br />WHEREAS, Council finds that secondhand dealers may provide a means of dis- <br />posing of stolen goods; that investigation by police agencies reveals that new, used and <br />stolen property are acquired and sold by secondhand businesses; and because secondhand <br />businesses can be ready vehicles for the disposal of stolen goods, such businesses should <br />be subject to controls used to decrease the potential trafficking in such items; and <br />WHEREAS, the City's regulations must be amended to reflect the present -day <br />needs for proper administration; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re- <br />vised Code, municipalities have the power of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Re- <br />vised Code, municipalities have the power to enact laws that are for the health, safety, <br />welfare, comfort and peace of the citizens of the municipality; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. New Chapter 737, Secondhand Dealers, of the Lakewood Codified Or- <br />dinances, shall be and hereby is enacted to read as follows: <br />CIiAPTER 737 <br />Secondhand Dealers <br />737.01 DEFINITIONS; SCOPE OF PROVISIONS. <br />(a) As used in this chapter: <br />
