143.99 PENALTY. <br />Whoever violates any provision of this chapter is guilty of a misde- <br />meanor of the fourth degree. <br />shall be and hereby is repealed, and new Chapter 143, City Records Commission, of the <br />Lakewood Codified Ordinances is enacted to read as follows: <br />CHAPTER 143 <br />CITY RECORDS COMMISSION <br />143.01 ESTABLISHMENT AND MEMBERSHIP <br />There is hereby established a City Records Commission to be coin - <br />posed of the Mayor or his or her appointed representative, as chairper- <br />son, the Director of Finance, the Director of Law and a citizen appoint- <br />ed by the Mayor. The commission shall appoint a secretary, who may <br />or may not be a member of the conunission and who shall serve at the <br />pleasure of the commission. <br />143.02 FUNCTIONS OF COMMISSION. <br />The functions of the City Records Commission shall be to provide rules <br />for retention and disposal of records of the City; to review, revise and <br />approve schedules of records retention; to review all applications for <br />records disposal and schedules of records disposition submitted by the <br />City; and to ensure compliance with general law related to records re- <br />tention, disposal and disposition. The commission shall meet at least <br />once every six months and upon the call of the chairperson. <br />143.03 COMPLIANCE REQUIRED. <br />No person having the custody of any records shall transfer, destroy or <br />otherwise dispose of them, or procure or permit the transfer, destruction <br />or other disposition of them without complying with the regulations <br />and procedures adopted by the City Records Commission in accordance <br />with this chapter. <br />143.04 COSTS. <br />Except as otherwise noted in this code or by general law, the City may <br />charge actual costs for copies, delivery and transmission of public rec- <br />ords and may require payment of costs in advance. The cost of employ- <br />ee time may not be included in the cost of copies or of delivery unless <br />otherwise permitted under general law. The City may choose to employ <br />the services, and charge the requester the costs of, a private contractor <br />to copy public records so long as the decision to do so is reasonable. <br />143.99 PENALTY. <br />Whoever knowingly violates Section 143.03 is guilty of a misdemeanor <br />of the fourth degree. <br />
