text that must be clearly legible to a donor of property, reading as fol- <br />lows: <br />"Placing donated items outside this box is prohibited and is punishable <br />as littering (L.C.O. 521.08)." <br />(6) No more than one donation box shall be permitted on any single parcel <br />of property. <br />(7) Any donation box placed or maintained in the City that is not permitted <br />by the City, and any donated items left outside a donation box, shall be <br />subject to impoundment by the City. If impounded, a donation box and <br />donated items may be released to the owner upon the payment of an <br />impound fee established by Council. If impounded for more than 30 <br />days, a donation box and donated items may be sold for scrap or other- <br />wise disposed of by the City. <br />(8) The permit issued for any donation box may be revoked, after reasona- <br />ble notice is attempted to be given to the donation box owner, if the do- <br />nation box is placed or maintained in violation of this chapter. <br />721.03 APPEALS. <br />Any person affected by a decision of the building commissioner under this chap- <br />ter may appeal from that decision to the Board of Building Standards and Build- <br />ing Appeals within 10 days of receiving notice of the decision. An appeal shall <br />not act as an automatic stay of the decision from which appeal has been made. <br />721.99 PENALTY. <br />Whoever violates any provision of this chapter is guilty of a minor misdemeanor <br />for a first offense, and for a second or subsequent offense, shall be guilty of a_ <br />misdemeanor of the fourth degree. <br />Section 2. Council hereby establishes an application fee of $100.00 per donation box <br />pursuant to Section 721.02(b)(5). <br />Section 3. Council hereby establishes an impound fee of $25.00 per day pursuant to Sec- <br />tion 721.02(d)(7). <br />Section 4. Any donation boxes existing in the City as of the effective date of this ordi- <br />nance shall be subject to the regulations in this ordinance. <br />Section 5. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council and <br />that all such deliberations of this Council and of any of its committees that resulted in such for- <br />mal action were in meetings open to the public in compliance with all legal requirements. <br />
