DEFERRED 3/21/16. <br />ORDINANCENO. 4 -16 By; Anderson, Bullock, Litten, <br />Marx, O'Leary, O'Malley. <br />AN ORDINANCE amending the Code to provide for the impounding and disposition of <br />certain animals, and establishing related charges. <br />WHEREAS, Section 505.03 of the Codified Ordinances stands to be amended to permit <br />the impounding and disposition of certain animals abandoned by their owners and to establish <br />related charges; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio, the Ohio Revised Code <br />and the Second Amended Charter of the City of Lakewood, municipalities have the power to <br />enact laws that are for the health, safety, welfare, comfort and peace of the citizens of the <br />municipality, and to provide for local self - government; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section I. Section 505.03, Impounding and Disposition; Records, of the Codified <br />Ordinances of the City of Lakewood, currently reading as follows: <br />505.03 IMPOUNDING AND DISPOSITION; RECORDS. <br />A police officer or the Animal Control Officer shall impound every dog and the <br />Animal Control Officer shall impound every cat found in violation of Section <br />505.02. <br />(a) If the impounded dog is not wearing a valid registration tag, the dog shall <br />forthwith be turned over to an officer charged by law with the custody and <br />disposal of such dogs. If the dog is wearing a valid registration tag or the <br />identity of the owner or harborer is otherwise established, notice shall be <br />given prior to or on the next working day to such owner or harborer that the <br />dog has been impounded. Notice may be by telephone or by residence <br />service to the last known address of such owner or harborer. The dog shall <br />not be released except upon the payment of the following charges: for <br />impounding any dog, ten dollars ($10.00); for giving notice, ten dollars <br />($10.00); for keeping any dog, ten dollars ($10.00) per day. Any dog not <br />redeemed by the regular business day after notice, as herein provided, is <br />given to the owner or harborer, or the next regular business day following <br />the date it is seized or impounded if the owner or harborer cannot be found, <br />may be sold or otherwise disposed of as provided in Ohio R.C. 955.16. <br />(b) If the impounded cat is wearing an identification tag or the identity of the <br />owner or harborer is otherwise established, notice shall be given on the next <br />regular business day to such owner or harborer that the cat has been <br />impounded. Notice may be by telephone or by residence service to the last <br />known address of such owner or harborer. The cat shall not be released <br />except upon the payment of the following charges: for impounding any cat, <br />ten dollars ($10.00); for keeping any cat, ten dollars ($10.00) per day. Any <br />
