driven in the center lane except when overtaking and passing <br />another vehicle where the roadway is clearly visible and such <br />center lane is clear of traffic within a safe distance, or when <br />preparing for a left turn, or where such center lane is at the <br />time allocated exclusively to traffic moving in the direction <br />the vehicle is proceeding and is posted with signs to give no- <br />tice of such allocation. <br />(3) Official signs may be erected directing specified traffic to use <br />a designated lane or designating those lanes to be used by traf- <br />fic moving in a particular direction regardless of the center of <br />the roadway, or restricting the use of a particular lane to only <br />buses or other vehicles during certain hours or during all <br />hours, and drivers of vehicles shall obey the directions of such <br />signs. <br />(4) Official traffic control devices may be installed prohibiting the <br />changing of lanes on sections of roadway and drivers of vehi- <br />cles shall obey the directions of every such device. <br />(b) Except as otherwise provided in this subsection, whoever violates <br />this section is guilty of a minor misdemeanor. If, within one year <br />of the offense, the offender previously has been convicted of or <br />pleaded guilty to one predicate motor vehicle or traffic offense, <br />whoever violates this section is guilty of a misdemeanor of the <br />fourth degree. If, within one year of the offense, the offender pre- <br />viously has been convicted of two or more predicate motor vehicle <br />or traffic offenses, whoever violates this section is guilty of a mis- <br />demeanor of the third degree. <br />Section 2. The Director of Public Works is authorized and directed to erect sign - <br />age or pavement markings on Clifton Boulevard permitting the use of bicycles in the <br />lanes already restricted to use by buses during certain hours, for as long as those bus -lane <br />restrictions remain in place. The operation of bicycles is hereby permitted in those bus <br />lanes during restricted hours. <br />Section 3. It is found and determined that all formal actions of this Council con- <br />cerning and relating to the passage of this ordinance were adopted in an open meeting of <br />this Council and that all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the public in compliance <br />with all legal requirements. <br />Section 4. This ordinance is hereby declared to be an emergency measure neces- <br />sary for the immediate preservation of the public peace, property, health, safety and wel- <br />fare in the City and for the usual daily operation of the City for the reasons set forth and <br />defined in its preamble, and provided it receives the affirmative vote of at least five <br />members of Council this ordinance shall take effect and be in force immediately, or oth- <br />erwise shall take effect and be in force after the earliest period allowed by law. <br />
