(c) No family swimming pool or family wading pool, as those terms <br />are defined in Section 1722.02, shall be located in any front yard or <br />side yard, and no family swimming pool or family wading pool <br />shall be located closer than five (5) feet to the side or rear property <br />line of the lot upon which it is situated. The Commissioner may <br />grant a variance to the five (5) foot side and/or rear tine require- <br />ment for portable family swimming pools, as that term is defined <br />in Section 1722.02, provided that written consent from each abut- <br />ting property owner is filed with the application for variance. <br />Section 4. Section 1125.10, Additional Accessory Structure Regulations, of the <br />Lakewood Codified Ordinances, currently reading as follows: <br />1125.10 ADDITIONAL ACCESSORY STRUCTURE REGULA- <br />TIONS. <br />(a) Accessory structures shall be constructed of non - combustible ma- <br />terial equivalent to a two -hour fire rating for wall and ceiling con- <br />struction and shall not be constructed within three (3) feet of a side <br />or rear property line. <br />(b) No family swimming pool shall be located closer than ten (10) feet <br />to the side or rear property line of the lot upon which it is situated. <br />The Commissioner may grant a variance to the ten (10) foot side <br />and/or rear line requirement for portable family swimming pools, <br />provided that written consent from each abutting property owner is <br />filed with the application for variance. <br />shall be and hereby is repealed, and new Section 1125.10, Additional Accessory Struc- <br />ture Regulations, of the Lakewood Codified Ordinances is enacted to read as follows: <br />1125.10 ADDITIONAL ACCESSORY STRUCTURE REGULA- <br />TIONS. <br />(a) Accessory structures shall be constructed of non - combustible ma- <br />terial equivalent to a two -hour fire rating for wall and ceiling con- <br />struction and shall not be constructed within three (3) feet of a side <br />or rear property line. <br />(b) No family swimming pool or family wading pool, as those terms <br />are defined in Section 1722.02, shall be located in any front yard or <br />side yard, and no family swimming pool or family wading pool <br />shall be located closer than ten (10) feet to the side or rear property <br />line of the lot upon which it is situated.
