ORDINANCE NO. 3 -18 <br />REFERRED TO THE HOUSING COMMITTEE <br />1/2/18. SECOND READING /deferred 1/16/18. <br />BY: Anderson, Bullock, George, Litten, <br />O'Leary, O'Malley, Rader. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest pe- <br />riod allowed by law, authorizing and directing the Director of Planning and Development or the <br />Mayor to enter into an agreement with Payne and Payne Custom Builders, Inc. for the sale of <br />2107 Robin Street, Lakewood, Ohio (PPN #315 -22 -074) and 2111 Robin Street, Lakewood, Ohio <br />(PPN# 315 -22 -120, pursuant to Section 155.07 of the Codified Ordinances. <br />WHEREAS, the City is the owner of the above listed properties and has negotiated an in- <br />fill project for three separate parcels with Payne and Payne Custom Builders, Inc.; and <br />WHEREAS, Payne and Payne Custom Builders, Inc. has already begun construction on a <br />third parcel, not the subject of the within matter, for two single family homes on one parcel that <br />will share common area and be subject to a home owners association; and <br />WHEREAS, this Council has determined it is in the best interest of the City to sell said <br />real property and that such sale shall further the interest of the City and its residents; and <br />WHERAS, this Council by a vote of at least five of its members determines that this or- <br />dinance is an emergency measure, and that this ordinance shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City <br />of Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health and safety, and to provide for the usual daily operation of municipal department in that <br />these properties are currently vacant and returning them to a tax generating status should be done <br />as quickly as possible; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Director of Planning and Development ( "Director ") or Mayor is hereby <br />authorized and directed, on behalf of the City, to enter into agreements, in substantially the same <br />form as those attached as Exhibit A and Exhibit B, with Payne and Payne Custom Builders, Inc. <br />for the sale of 2107 Robin Street, Lakewood, Ohio (PPN #315 -22 -074) and 2111 Robin Street, <br />Lakewood, Ohio (PPN# 315 -22 -120), pursuant to Section 155.07 of the Codified Ordinances. <br />Section 2. The Director, Mayor or the Director of Law is hereby authorized and directed <br />to enter into agreements and execute all ancillary and related instruments for the sale of said real <br />property. <br />
