of any exterior wall is movable and is connected or attached to an in- <br />door restaurant, bar, tavern or nightclub. <br />shall be and hereby is repealed, and new Section 1103.02(zz), Definitions (Out- <br />door /Seasonal Dining Facility), of the Lakewood Codified Ordinances is enacted to read <br />as follows: <br />1103.02 Definitions <br />(zz) OUTDOOR/SEASONAL DINING FACILITY means an out- <br />door dining area; or an area wherein twenty -five percent (25 %) or more <br />of any exterior wall is movable and is connected or attached to an in- <br />door restaurant, bar, tavern or nightclub; or any combination thereof. <br />Section 2. Section 1161.03(t) of the Lakewood Codified Ordinances currently <br />reading as follows: <br />1161.03 Supplemental Regulations for Specific Uses <br />(t) Outdoor /Seasonal Dining Facility <br />(7) The total number of seats for the Outdoor /Seasonal Dining Facili- <br />ty shall not exceed 25% of the maximum number of previously ap- <br />proved indoor seats for the Restaurant Use. It is found and determined that all formal actions of this Council con- <br />cerning and relating to the passage of this ordinance were adopted in an open meeting of <br />this Council and that all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the public in compliance <br />with all legal requirements. <br />Section 4. This ordinance is hereby declared to be an emergency measure neces- <br />sary for the immediate preservation of the public peace, property, health, safety and wel- <br />fare in the City and for the usual daily operation of the City for the reasons set forth and <br />defined in its preamble, and provided it receives the affirmative vote of at least five <br />
