(b) This section does not relieve the driver of a public safety vehicle, <br />emergency vehicle, road service vehicle, vehicle used by the Public Util- <br />ities Commission to conduct motor vehicle inspections in accordance <br />with Ohio R.C. 4923.04 and 4923.06 or a highway maintenance vehicle <br />from the duty to drive with due regard for the safety of all persons and <br />property upon the highway. <br />(c) No person shall fail to drive a motor vehicle in compliance with <br />subsection (a)(1) or (2) of this section when so required by subsection <br />(a) of this section. <br />(d) (1) Except as otherwise provided in this subsection, whoever vio- <br />lates this section is guilty of a minor misdemeanor. If, within one year <br />of the offense, the offender previously has been convicted of or pleaded <br />guilty to one predicate motor vehicle or traffic offense, whoever violates <br />this section is guilty of a misdemeanor of the fourth degree. If, within <br />one year of the offense, the offender previously has been convicted of <br />two or more predicate motor vehicle or traffic offenses, whoever violates <br />this section is guilty of a misdemeanor of the third degree. <br />(2) Notwithstanding Section 303.99(b), upon a finding that a person <br />operated a motor vehicle in violation of subsection (c) of this section, the <br />court, in addition to all other penalties provided by law, shall impose a <br />fine of two times the usual amount imposed for the violation. (ORC <br />4511.213) <br />SECTION 7. Section 33 5.12, Stopping After Accident Upon <br />Streets; Collision With Unattended Vehicle, of the Lake- <br />wood Codified Ordinances, currently reading as follows: <br />335.12 STOPPING AFTER ACCIDENT UPON STREETS; <br />COLLISION WITH UNATTENDED VEHICLE. <br />(a) In case of accident to or collision with persons or property upon <br />any of the public roads or highways , -due to the driving or operation <br />thereon of any motor vehicle, the person driving or operating the motor <br />vehicle, having knowledge of the accident or collision , immediately <br />shall stop the driver's or operator's motor vehicle at the scene of the <br />accident or collision and shall remain at the scene of the accident or <br />collision until the driver or operator has given the driver's or operator's <br />name and address and, if the driver or operator is not the owner, the <br />name and address of the owner of that motor vehicle, together with the <br />registered number of that motor vehicle, to any person injured in the ac- <br />cident or collision or to the operator, occupant, owner, or attendant of <br />any motor vehicle damaged in the accident or collision, or to any police <br />officer at the scene of the accident or collision. <br />In the event the injured person is unable to comprehend and record the <br />information required to be given by this section, the other driver in- <br />volved in the accident or collision forthwith shall notify the nearest po- <br />Fice authority concerning the location of the accident or collision, and <br />the driver's name, address and the registered number of the motor ve- <br />hicle the driver was operating, and then remain at the scene of the acci- <br />dent or collision until a police officer arrives, unless removed from the <br />scene by an emergency vehicle operated by a political subdivision or an <br />ambulance. <br />
