(m) "Premises ", as applied to property, includes land and buildings. (nn) "Property" means real and personal property. (ORC 1.59(E)) "Personal property" includes all property except real. "Real property" includes lands, tenements and hereditaments. (no) "Public authority" includes boards of education; the Municipal, County, State or Federal government, its officers or an agency thereof, or any duly authorized public official. (op) "Public place" includes any street, sidewalk, park, cemetery, school yard, body of water or watercourse, public conveyance, or any other place for the sale of merchandise, public accommodation or amusement. (pq) "Registered mail' includes certified mail and "certified mail' includes reg- istered mail. (ORC 1.02(G)) (qr) "Rule" includes regulation. (ORC 1.59(F)) (rs) "Sidewalk" means that portion of the street between the curb line and the adjacent property line intended for the use of pedestrians. (st) "This State" or "the State" means the State of Ohio. (ORC 1.59(G)) (tu) "Street' includes alleys, avenues, boulevards, lanes, roads, highways, via- ducts and all other public thoroughfares within the Municipality. (tw) °Tenant" or "occupant', as applied to premises, includes any person hold- ing a written or oral lease, or who actually occupies the whole or any part of such premises, alone or with others. (vw) "Whoever" includes all persons, natural and artificial; partners; princi- pals, agents and employees; and all officials, public or private. (ORC 1.02(A)) (wx) "Written" or "in writing" includes any representation of words, letters, symbols or figures. This provision does not affect any law relating to signa- tures. (ORC 1.59(J)) Section 24. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and that all such deliberations of this Council and of any of its committees that resulted in such for- mal action were in meetings open to the public in compliance with all legal requirements. Section 25. This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in its preamble, and provided it receives the affirmative vote of at least five or two thirds of the members of Council, as applicable, this ordinance shall take effect and be in force immediately, or otherwise it shall take effect and be in force after the earliest period allowed by law.
