ORDINANCE NO. 53 -18 <br />Placed on <br />to Finance <br />12/3/18 <br />Anderson, Bullock, George, Litten <br />O'Leary, O'Malley, Rader <br />1st reading and referred <br />11/19/18; 2nd reading <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force at the <br />earliest period allowed by law, amending section 902.04, Rates and Charges, of the Codified <br />Ordinances of the City of Lakewood for the purpose of adjusting sewer rates charged against <br />each lot, parcel of land or premises which may have an active sewer connection with the <br />Municipal wastewater disposal system or which may otherwise discharge wastewater either <br />directly or indirectly into such system or any part thereof. <br />WHEREAS, the current sewer rate is insufficient to allow the Wastewater Treatment <br />Fund and Wastewater Collections System Fund to continue to be self - supporting; and <br />WHEREAS, in order to offset the continuing general increases in capital costs of the <br />wastewater collections and treatment facilities it is necessary for the City to increase the rates <br />charged to the users of the wastewater disposal system as well as provide for the anticipated <br />annual capital needs for the wastewater collection and treatment system; and <br />WHEREAS, Chapter 902 of the Codified Ordinances authorizes the City to set sewer <br />rates to distribute the costs of operation and maintenance of the wastewater disposal system and <br />the costs to maintain compliance with applicable standards and regulations of the U.S. E.P.A. <br />proportionately upon all users of said system; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments, and to provide for the usual daily <br />operation of municipal departments in that these rates and charges must be in place for the 2019- <br />2023 fiscal years. Now therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO <br />Section 1. That subsection 902.04(d), Rates and Charges, of the Codified Ordinances of <br />the City of Lakewood currently reads as follows: <br />902.04 RATES AND CHARGES. <br />(d) Effective January 1, 2018, sewer rates charged by the Lakewood Division <br />Utility Billing shall be billed at a rate of not more $6.82 per one hundred cubic <br />feet of metered water consumption. <br />is hereby repealed. <br />
