RESOLUTION NO. 3446 BY Nr. Vickery <br /> <br /> ~ER~S~ the Regional Planning Commission is willing to undertake the <br />preparation of a building code adaptable for use generally inmunmc~pallt~es' · · ' <br />within Cuyahoga County, including this municipality, and <br /> <br /> WHEREAS, the Regional Planning Commission has estimated the overall cost <br />of the preparation of such a code to be $24~000.00, and <br /> <br /> ~EREAS, the Regional Planning Commission has asked this municipality <br />to agree to contribute the s~m~ of $2,010o0~, which amoun~ represents the propor- <br />tionate share of the total estimated cost of this municipality, said sum to be <br />payable 50% upon the passage of this resolution and 50% on or before February l, <br />1951, and <br /> <br /> WHEREAS, this municipality is in need of an immediate revision or ~e- <br />codification of its existing building code and ordinances relating thereto, and <br />it is determined that the program as proposed by the Regional Planning Commission <br />is to the ~dvantage of this municipality, as well as other municipalities within <br />the county, and <br /> <br /> WHEREAS, it is determined that the amount of the contribution requested <br />is reasonable; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council approve the program of the Regional <br />Planning Commission to undertake the preparation of ~a building code adaptable <br />for use in this municipality as well as other municipalities in the county, and <br />this municipality hereby agrees to contribute, in addition to its annual dues, <br />the sum of $2,010.00, one-half of such sum to be paid upon the passage of this <br />resolution and the balance on February l, 1951~ on the understanding that if <br />upon the completion of the progr~n any funds remain in the Building Code Fund <br />of the Regional Planning Commission, such surplus will be refunded to each con- <br />tributing municipality in proportion of its contribution to the total contribu- <br />tion by all municipalities. <br /> <br /> Section 2. That the Clerk be, and he is hereby authorized and directed <br />to make such payments to the Regional Plauning Co~maission in accordance with the <br />foregoing Section, by drawing checks payable to the ~nditor of Cuyahoga County to <br />the account of Building Code Fund of the Regional Planning Commission° <br /> <br /> Section 3. This resolution shall be COnsidered as an emergency measure <br />or one necessary for the Lmmediate preservation of the public peace, health and <br />safety of the municipality in that unless a new building code is adopted at the <br />earliest time possible, lives may be endangered and property values damaged, and <br />provided it receives the affirmative vote of two-thirds of the members elected <br />to Council, therefore, this resolution shall take effect immediately upon its <br />passage and upon its approval by the MaYor, otherwise from and after the earliest <br />period allowed by law. <br /> <br />Adopted: <br /> <br />15, 195o <br /> <br />~Y~mo R.
