p <br /> RESOLUTION N0. 35l~S BY Mr. Vickery <br /> AN EMERGENCY RESOLUTION authorizing and instructing the Mayor to execute <br /> a supplemental agreement with the Westlake Cab Service Company and the Cleveland <br /> Trust Company to provide for an increase in the security covering property damage <br /> in the event of accidental injury and declaring an emergency. <br /> ~'HEREAS~ the City of Lakewood heretofore has entered into an agreement <br /> with the Westlake Cab Service Company and the Cleveland Trust Company ender <br /> which the Westlake Cab Service Company has agreed to furnish security to cover <br /> payment of final judgments for personal injury and property damage suffered in <br /> the event of aecident~ the security for property damage being limited to one <br /> thousand dollars (~1~000o00); and <br /> WHEREAS since the execution of said agreement, the statutes of Ohio have <br /> been amended to require that the security for final judgments based upmn accidental <br /> injury to property beat least in the amount of five thousand dollars($5~000,00); <br /> and <br /> 4VHEREAS~ the Westlake Cab Service Company has tendered a supplemental <br /> agreements under the terms of which the original agreement hereinabove referred <br /> to will be amended by increasing the amount of the security agreed to be furn- <br /> fished to cover final judgments for property damage arising through accidental <br /> means from one thousand dollars ($1~000o00) to five thousand dollars ($5000.00); <br /> and <br /> 'wHEREAS~ said supplemental agreement makes no other change inthe terms <br /> .and provisions of said original agreement hereinabove referred to; and <br /> VVIiEREAS~ an emergency exists for the reasons hereinafter stated re- <br /> quiring that this resolution go into immediate effects noer~ therefore <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKE9~OOD, STATE OF OHIO: <br /> i <br /> Section le The supplemental agreement hereinabove referred to shall <br /> =1 forthwith be submitted to the Law Director for examination as to form, <br /> - <br /> Section 2. If said supplemental agreement is approved by the Law Director <br /> as to form, he shall forthwith endorse upon it his such approval and transmit the <br /> supplemental agreement thus approved to the Mayor. In the event that the supple- <br /> mental agreement is disapproved by the Law Directory he shall forthwith transmit <br /> i the agreement to the Mayor together with a written statement of the reasons for <br /> his failure to approve the samee <br /> Section 3o The Mayor forthwith upon receiving the approved supplemental <br /> agreement, if the sane is approved by the Law Director, shall execute said sup- <br /> <br /> _ plemental agreement on behalf of the City of Lakewood. In the event that such <br /> agreement is not approved by the Law Direetor~ or ifs for any reasons the Mayor <br /> shall fail or refuse to execute said agreements he is hereby instructed forth- <br /> <br /> ` with to notify the Councih in writings of such fact and of the reasons therefor. <br /> <br /> _ Section Lto This resolution is hereby declared to be an emergency measure <br /> for the reasons that the'i~nmediate execution of said supplemental agreement is <br /> necessary to maintain uninterrupted taxicab operation in the City of Lakewood <br /> and that it involves the customary and usual daily operations of a city depart- <br /> meat. <br /> Adopted: April 6, 1953 <br /> George F. duinn <br /> esi en of ouncx <br /> H.
