~ - <br /> i <br /> "f <br /> RESOLUTION N0. 3566 BY Mro Faisgrieve <br /> AN F~~IER.GENCY RESOLUTION authorizing the Mayor, ex-officio Director of <br /> Public Works to accept, on behalf of the City of Lakewood, the sum of Three Thousand <br /> Dollars ($3,000.00) from the Cleveland Transit System of the City of Cleveland in <br /> full payment of the latterts share of the cost in the resurfacing of Sloane Avenue <br /> in the City of Lakewood. <br /> <br /> _ WHE~tEAS, by legislation duly adopted, including Resolution Noo 3495, <br /> Ordinance Noo 1+771, Resolution Noo 3497 and Resolution Noo 3502, this Council de- <br /> _ termined to cooperate with the State of Ohio in the cost of improving certain streets <br /> in the City of Lakewood, including Sloane Avenue; and <br /> WE~REAS, pursuant to Ordinance Noo 4260, as amended, the City of Cleveland <br /> was granted a permit for continued operation of the Cleveland Transit System within <br /> u~, the City of Lakewood on the condition, among others, that the City of Cleveland shall <br /> r';~<h~ maintain in constant repair the certain track areas as in said ordinance more speci- <br /> fically described; and <br /> WHEREAS, differences of opinion have arisen between the City of Lakewood <br /> and the Cleveland Transit System with respect to the allocation between them of the <br /> cost of such resurfacing; and <br /> WHEREAS, the Cleveland Transit System has offered payment of the sum of <br /> Three Thousand Dollars 03,000.00) conditioned upon the release of the Cleveland <br /> Transit System by the City of Lakewood of its obligation to maintain and repair the <br /> track area in Sloane Avenue; and <br /> WHEREAS, this resolution Constitutes an emergency for the reasons that it <br /> is considered to be in the interests of the City of Lakewood that such differences <br /> of opinion be forthwith terminated by the acceptance of said stun, and in that it <br /> provides for the public welfare and the usual dai.].y operation of a municipal depart- <br /> ment; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section to That the Mayor, ex-officio Director of Public Works be, and he <br /> is hereby, authorized and directed, on behalf of the City of Lakewood, to accept <br /> from the Cleveland Transit System of the City of Cleveland the stun of Three Thousand <br /> Dollars ($3,000000) as and in full payment of the City of Clevelandts share of the <br /> cost of resurfacing Sloane Avenue in the City of Lakewood, and that upon payment oP <br /> such stmm, the City of Cleveland and the Cleveland Transit System shall be, and they <br /> `:j are hereby, released from further obligation to maintain and repair the track area <br /> '.;i within Sloane Avenue in the City of Lakewoode <br /> Section 2.
