{ <br /> f <br /> RESOLUTION N0. 3567 BY Mro Gottermeyer <br /> AN EMERGENCY RESOLUTION authorizing the Mayor, ex-officio Director of <br /> Public Works, to accept, on behalf of the City of Lakewood, the sum of Twenty <br /> Thousand Dollars ($20,000.00) from the Cleveland Transit System of the City of <br /> Cleveland, in full payment of the latterts share of the cost in the resurfacing of <br /> Detroit Avenue ix+ the City of Lakewood. <br /> - WHEREAS, by Ordinance Noo 54-53, adopted July 6, 1953, the City of Lakewood <br /> gave consent to Cuyahoga County for the improvement of Detroit Avenue and Bridge <br /> Approaah, by resurfacing the existing pavement with asphaltic ooncretee The City of <br /> Lakewood obligated itself to pay twenty-five percent (25%) of the cost oY such im- <br /> provements By Ordinance No. 55-53, adopted July 6, 1953,.the Council of the City of <br /> Lakewood authorized the Mayor, on behalf of the City of Lakewood to enter into an <br /> agreement with the Board of County Commissioners for the resurfacing of Detroit <br /> Avenue and Bridge Approach, from Highland Avenue to Sloane Avenue, and <br /> WHEREAS, pursuant to Ordinance Noo k26o, as amended, the City of Cleveland <br /> was granted a permit for continued operation of the Cleveland Transit System within <br /> the City of Lakewood on the condition, among others, that the City of Cleveland <br /> shall maintain in constant repair the certain track area as i.n said ordinance more <br /> specifically described, and, <br /> WHEREAS, differences ofopinion have arisen between the City of Lakewood and <br /> the Cleveland Transit System with respect to the allocation between them of the cost <br /> <br /> - of such resurfacing, and, <br /> WHEREAS, the Cleveland Transit System on August 31, 1953 agreed to pay the <br /> sum of Twenty Thousand Dollars 020,000.00) towards the payment of the cost of the <br /> Detroit Avenue resurfacing improvement, conditioned upon the release of the Cleveland <br /> Transit System by the City of Lakewood of its obligation to maintain and repair the <br /> track area in Detroit Avenue, and, <br /> - WHEREAS, this resolution constitutes an emergency for the reasons that it <br /> is considered to be in the interests of the Gity of Lakewood that such differences <br /> of opinion be forthwith terminated by the acceptance of said avm of Twenty Thousand <br /> Dollars ($20,000000) and in that it provides for the public welfare and the usual <br /> °.~st daily operation of a municipal department, now, therefore, <br /> ~ BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO; <br /> Section to That the Mayor, ex-officio Director of Public Works be, and he <br /> is hereby, authorized and directed, on behalf of the City of Lakewood, to accept <br /> from the Cleveland Transit System of the City of Cleveland the sum of Twenty Thousand <br /> Dollars (~20,000o00} as and in full payment of the Oity of Cleveland}s share of the <br /> cost of resurfacing Detroit Avenue and Bridge Approach in the City of Lakewood from <br /> Highland Avenue to Sloane Avenue and that upon payment of such sum the City of <br /> _ Cleveland and the Cleveland Transit System shall be and they are hereby released <br /> from further obligation to maintain and repair the track area within Detroit Avenue <br /> and Bridge Approaah in the City of Lakewood. <br /> Section 2.
