_ r_ RESOLUTION N0. 35$3 BY Mr. Gottermeyer AN EN~RCENCY RESOLUTION authorizing and directing the Director of Law to take the necessary steps to join with the Directors of Law and Solicitors of other municipalities in Cuyahoga County to appeal the action of the County Budget Commission, relating to the alloca- tion of the intangible tax, to the Board of Tax Appeals of the State of Ohio and to the Supreme Court of Ohio, if necessary. WHEREAS, the County Budget Commission has not allocated to the City of Lakewood a sufficient amount of money from intangible =_i tax, and WHEREAS, the Directors of Law and Solicitors of other munic- ipalities are making a joint appeal to the Board of Tax Appeals of the State of Ohio, requesting that the action of the County Budget s~ Commission be reversed, and WHEREAS, an emergency exists in order to provide for the ' immediate preservation of the public property, health and safety and to provide for the usual daily operation of a municipal department, now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO; Section 1. That the Director of Law be and he is hereby authorized and directed to join with the Directors of Law and Solicitors of other municipalities in Cuyahoga County in an appeal from the decision of the Cuyahoga County Budget Commission in its allocation of intangible tax money, to the Board of Tax Appeals of the State of Ohio, and the Supreme Court of Ohio, if necessary. Section 2. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council3 it shall take effect and be in force immediately upon its adoptzon and approval by the Niapor.
