_ r_ <br /> RESOLUTION N0. 35$3 BY Mr. Gottermeyer <br /> AN EN~RCENCY RESOLUTION authorizing and directing the Director <br /> of Law to take the necessary steps to join with the Directors of Law <br /> and Solicitors of other municipalities in Cuyahoga County to appeal <br /> the action of the County Budget Commission, relating to the alloca- <br /> tion of the intangible tax, to the Board of Tax Appeals of the State <br /> of Ohio and to the Supreme Court of Ohio, if necessary. <br /> WHEREAS, the County Budget Commission has not allocated to <br /> the City of Lakewood a sufficient amount of money from intangible <br /> =_i tax, and <br /> WHEREAS, the Directors of Law and Solicitors of other munic- <br /> ipalities are making a joint appeal to the Board of Tax Appeals of <br /> the State of Ohio, requesting that the action of the County Budget <br /> <br /> s~ Commission be reversed, and <br /> WHEREAS, an emergency exists in order to provide for the <br /> ' immediate preservation of the public property, health and safety and <br /> to provide for the usual daily operation of a municipal department, <br /> now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO; <br /> Section 1. That the Director of Law be and he is hereby <br /> authorized and directed to join with the Directors of Law and <br /> Solicitors of other municipalities in Cuyahoga County in an appeal <br /> from the decision of the Cuyahoga County Budget Commission in its <br /> allocation of intangible tax money, to the Board of Tax Appeals of <br /> the State of Ohio, and the Supreme Court of Ohio, if necessary. <br /> Section 2. That this resolution is hereby declared to be <br /> an emergency measure for the reasons stated in the preamble hereof <br /> and provided it receives the affirmative vote of two-thirds of all <br /> members elected to Council3 it shall take effect and be in force <br /> immediately upon its adoptzon and approval by the Niapor. <br /> F Adopted; January 4. 1954 <br /> ~rs_ Wm.
