RESOLUTION NO. 3657 BY Mr. ~ottsrmeyer AN E~ERGENOY RESOLUTION authorizingThe Horvits Company to secure ~ublic Liability Insurance to protect the City of Lake~ood in connection with resurfacing Hilliard Road from Fmdison Avenue to warrsn Road and authorizing and directing the D~rector of Finance to reimburse The Horv~tz Company for the premium paid for such insurance. W~E~EAS, although informed during 195] of the necessity for such protection in future cases of improving county roads at Joint expense, the County ef Cuyahoga furnished the City with old forms of consent and a~reement for purpose~ of }he above described improvement and then, with- out waiting for adoption thereof by the City, proceeded to advertise for Bids w~thout ~equ/ring insurance aS-provided in para~Taph g of the agree- ment authorized by Ordinance No. AO~ and WHEREAS~ in order to proceed with such much needed improvement it became necessary to repeal ordinance No, ~0-5~ and authorise an ment omitting such insurance requirement intending, however, that such public liability insurance would be obtained at City expense arisinE from its interest and possible obligations under Eevisad Cods 72~.01~ and ~EREAS, this resolution is declared to be an emergency for the reasons that it is necessary to begin such ~mprovement as soon as poss- ible in Order to complete it during seasonable weather and in that this resolution provides for the public welfare and the operation of muni- cipal departments, now therefore, BE IT KESOLV~D BY T~E COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO~ Section 1, That The Horvitz Company as the contractor is au- thorized before COmmencing work on the improvement of Hilliard Road from Madison Avenue to ~arren Road by resurfacing, to take out and to~ keep in effect until the work is completed and acCepted, Public Lia- bility Insurance, in an insurance company authorized to do business in the State of Ohio, in favor of and to protect the City of Lakewood as the insured against loss and damage to property and against all claims, d~mands, suits or Judgments arising because of, or reSulting from operations of and performance of the work by the contractor, its sub contractors, agents or employes, such insurance to provide for payments of amounts, not less than $50,000. for injuries to one person and not less than ~100,OO0. for injuries to ~ore than one person i~ any o~e accident~ and amounts not less than $10,000. for property damage xn any one accicent a~dwith total aggregate limit for property damages for not less than $20,000. and to deliver the policy of insurance to the City of Lakewood; and thee Director of Finance is authorized and directed to reimburse The Horvit~Company for the premium paid for such insurance. Section 2. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption.
