RESOLUTION NO. 3675 <br /> <br />BY I~Ir. Gottermeyer <br /> <br /> ~u emergency resolution authorizing the settlement of the claim of the city of <br />Lakewood against Fred Alston for six hundred dollars, and directing the execution <br />of a proper release therefor. <br /> <br /> WHEi~EAS, Fred Alston has offered the sum of five hundred dollars in cash <br />and the delivery of a cognovit promissory note for one hundred dollars, due on <br />May Z, 1956, in full settlement of claims, damages and causes of action that the <br />city of Lakewood may have against him for property damage done to a 1955 Ford Sedan <br />owned by the city of Lakewood, as a result of a collision between the said Fred Alston <br />and said Ford Sedan on November ZS, 1955, at the intersection of Clifton Boulevard <br />and Belle Avenue in the city of Lakewood, Ohio, and <br /> <br /> WHEREAS, An emergency exists in that such offer is made subject to <br />immediate acceptance and that a delay may cause a pecuniary loss to the city of <br />Lakewood, and in order to provide for the immediate preservation of the public peace, <br />property, health or safety or providing for the usual daily operations of a municipal <br />department~ now therefore <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO <br /> <br /> Section 1. That the offer of Fred Alston to pay five hundred dollars in cash <br />and to deliver his cognovit promissory note for one hundred dollars, due on May Z, <br />1956, in full settlement of all claims, damages and causes of action sustained by the <br />city of Lakewood in the accident aforesaid, be and is hereby accepted. <br /> <br /> Section Z. That the mayor, chairman of the council committee on claims and <br />the director of law are hereby authorized and directed to execute a proper release in <br />favor of Fred Alston, and to transmit such release to the director of finance, who <br />shall deliver the release to Fred Alston upon the payment of six hundred dollars; <br />that the amount received in settlement be credited to the proper fund. <br /> <br /> Section 3. That this resolution is hereby declared to be an emergency <br />resolution for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of the members elected to council, it shall take effect <br />and be in force immediately upon its approval by the mayor. <br /> <br /> President <br /> <br />Approved: ~Z~f.~/---./_F."'~ <br /> <br /> Mayo <br /> <br /> <br />
