RESOLUTION NO. 3715 BY Mro Gottermeyer _ - ~AN ~E~.~GE~9~ RE~O~TION authorizing a~d .direc~in~ the Mayor, on oenali oI ~ne Gluy cz La~ewood, ~o employ ~qulre, ~ancers and Dempsey, Attorneys at Law, to consider the legal aspects of and to prepare all instruments necessary for the issuance of revenue bonds for the purpose of acquiring and constructing off-street parking areas in the Westwood- Lakeland area, Ridgewood - Lakewood area, Kidney Cemetery area and Wagar Cemetery area. WHEREAS, By Grdinance Nos. ~7-56 and 58-56, an agreement with Wm. J. Mericka and Co., Inc. was authorized for the making of surveys, reports and recommendations relative to Dff-street parking, and WHE.R~.AS, It is advisable to have the bond counsel advise and cooperate wmth the said Wm. J. Mericka and Co., Inc. in the ~repara- tion of surveys, reports and recommendations relative to off Street parking, and WHEREAS, An emergency exists for the reasons that in order t~ effecbuate the said preparation of surveys, reports and recommendations, and to provide financing for the off-street parking facilities in the Westwood - Lakeland area, Ridgewood - Lakewood area, Kidney Cemetery area and Wagar Cemetery area, and to provide for the public safety and welfare and the usual daily operation of a mumicipal department, it is necessary to immediately provide for the preparation of further nec- essary legislation, agreements, bonds and other instruments, now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to employ Squire, Sanders and Dempsey to prepare all legisla- tion, agreements, bonds and other instruments as may be necessary and incident to the issuance of revenue bonds to provide financing for ~he purpose of acquiring the realty heretofore proposed by Council for the ~estwood - Lakeland area, Rtdgewped - Lakewood area, Kidney Cem- etery area and Wagar Cemetery area, for off-street parking facilities and for the construction and operation of off-street parking areas thereon. Ail compensatiou for such services shall be paid from proceeds received from the sale of the revenue bonds, if such bonds are not sold, from the General Fund - General Miscellaneous Appropriation. Section 2. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
