RESOLUTION NO. 3724 BY Mw. Quinn <br /> <br /> AN E~RGENCY RESOLUTION authorizing the Mayor, on behalf of the <br />City of Lakewood, to grant authority to the Lakewood Chamber of <br />Cormnerce to construct, otherwise provide for and carry out a pyro- <br />technic or fireworks display in Lakewood Park, July 25, 1956, subject <br />to the conditions hereinafter stipulated. <br /> <br /> ~EREAS, this resolution constitutes an emergency for the <br />reasons that although the proposed display is to be made July 25, <br />1956, General Offenses Code Section 931.095 provides for such <br />authority to be granted by the Mayor pursuant to a resolution adopted <br />by Council, and in that it provides for the public welfare and safety <br />and the usual daily operation of a municipal department, now, there- <br />fore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAK~OOD, STATE OF <br />OHIO: <br /> <br /> Section 1. That the Mayor be, and he is hereby, authorized, on <br />behalf of the City of Lakewood, to grant authority to the Lakewood <br />Chamber of Commerce to construct, otherwise provide for and carry <br />out a pyrotechnic display of fireworks in Lakewood Park, July 25, <br />1956, provided that there be first fUrnished to the Cit~ of Lakewood <br />public liability insurance in limits of at least $25,000.00 for <br />injuries to one person ~nd $100,000.00 for injuries to more than one <br />person and of at least $10,000.00 for damages to property of one <br />owne~ an~ $50,000.00 for damages to property of more than one owner <br />or, mn lieu of such insurance, a bond for equivalent amounts and <br />purposes undertaking to indemnify and save harmless the City of <br />Lakewood, its officers and agents, from all claims, suits and actions <br />of every kind and description made or brought against the City of <br />Lakewood or its officers and agents, or both, for, by reason of or <br />on account of any injuries or damages to persons or property received <br />or sustained by any person or persons Sn, by reason of, on account of <br />or growing out of said Pyrotechnmcal dmsplay of fireworks or by Or in <br />consequence of any materials, explosives or explosions in connection <br />therewith, such insurance or bond being, in form and surety, satis- <br />factory to the Mayor; and provided further that no detonable aerial <br />or ground bombs shall be exploded and that the display be confined <br />to ornamental designs and fireworks which do not create loud noises. <br /> <br /> Section 2. This resolution is hereby declared to be an emer- <br />gency measure for the reasons stated in the preamble hereof and, <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force i~nediately <br />upon its adoption and approval by the Mayor. <br /> <br />Adopted: _ July 16, 1956 <br /> <br />Approved: July 17, 1956 <br /> <br /> _ s/ Frank P.
