RESOLUTION NO. 3897 BY: Messrso ~GaYdOs, Gottermeyer, <br /> Lawther, Ward, <br /> Chockley. <br /> <br /> A RE.SOLUTION authorizing the Mayor, as Director of Public Works, <br />to advertise for bids for the purchase from the City of Lakewood of <br />the real estate known generally as the Scenic Park, which property <br />is now owned by the City and is not needed for any municipal purpose. <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: <br /> <br /> Section 1. That the Mayor, as Director of Public Works, be and <br />he is hereby authorized to advertise for bids for the purchase from <br />the City of Lakewood of the premises known generally as the Ssenic <br />Park. <br /> <br /> Section 2. Tha~ the premises may be divided into two or more <br />parts and such parts be the subject of separate advertisement; that <br />the advertisemen~ shall state that any contract for the sale of the <br />premises known generally as the Scenic Park shall be subject to the <br />approval of Council; that the conveyance will be by the usual form <br />of limited warranty deed used by the City, and shall be subject to <br />taxes and assessments, both general and special, if any, all of <br />which shall be pro-rated as of the date of filing the deed for record, <br />and shall be subject to such reservations and conditions as the <br />Director of Public Works shall deem necessary for the preservation <br />of easement rights for municipal utilities and also subject to the <br />necessary easemen= rights to other portions of theCity owned properties <br />located in the so called Rooky River Valley; that the escrow fee shall <br />be paid one-half by the City and one-half hy the purchaser; and that <br />the City shall furnish a title guarantee in the amount of the sum paid <br />by the successful bidder; and that the City reserves the right to re- <br />ject any and all bids, or any par~ thereof. <br /> <br /> Section 3. That this resolution shall take effect and be in <br />force upon its passage and approval by the Mayor at the earliest <br />period allowed by law. <br /> <br />Adopted:_~ July 7. i9~8 <br /> <br />Approved: .
