RESOLUTION NO. 4073 BY: Messrs. Gottermeyer, Huffman, Lawther~ Ward, Williamson, Chockley, Gaydos. AN EMERGE~SOLUTION authorizing and directing the Finance Director of the City of Lakewood to accept the principal and interest on special assessments levied on permanent parcel number 315-5-72 on the Cuyahoga County Auditor's Records and authorizing the County Auditor to cancel said special assessments for the year 1961 and subsequent years. WHEREAS, The City has special assessments charged against the property hereinafter described and levied under Ordinance No. 3?-58, adopted by the Council of the City Of Lakewood on July 7, 1958, and, WHEREAs, The owner of the said property has tendered pay- ment of the principal portion and interest on the special assessments levied on said parcel pursuant to the provisions of Section 5719.16 of the Revised Code of th~ State of Ohio, and, WHEREAS, This resolution constitutes an emergency measure providing for the usual daily operation of a municipal department~ now, therefore, BE iT RESOLVED BY THE COUNCIL OF THECITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Finance of the City of Lakewood be and he is hereby authorized and directed to accept the sum of $102.24 tendered in payment of the principal and interest for the year 1961 and subsequent years of special assessments charged against the property described as permanent parcel number 315-5-72 on the Auditor's Records of Cuyahoga County, Ohio, and levied under Ordinance No. 3?-58, adopted by the Council of the City of Lakewood on July 7, 1958. Section 2. That said special assessments as hereinbefore set forth having been accepted as set forth in Section I hereof, and the Auditor of Cuyahoga County be and he is hereby authorized to cancel said special assessments for the year' 1961 and subsequent years levied under Ordinance No. 37-58, adopted by the Council of the City of Lakewood on July 7, 1958 on permanent parcel number 315-5-72 on the County Auditor's Records and further described as being sublot number 206 in the Homeside Company's Waterbury-Parkside Subdivision, each annual assessment being in the amount of $25.56. Section 3. That the Clerk of Council be and he is hereby authorized and directed to deliver acertified copy of this resolution to the Auditor Of Cuyahoga County for the purpose of having said special assessments cancelled. Section 4. That this resolution is hereby declared to be an emergencymeasure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
