Usher, Ward, <br /> RESOLUTION NO. 4147 BY: Wendling, Williamson <br /> Gaydos, Huffman, <br /> Lawther. <br /> AN EMERGENCY RESOLUTION authorizing and directing <br />the Mayor to engage the firm of Squire, Sanders and Dempsey <br />to prosecute an action in declaratory judgment for an <br />interpretation of the provisions of Article XIV, Section 29 <br />of the Charter of the City of Lakewood. <br /> <br /> WHEREAS, It has come to the attention of this <br />Council that there is a difference of opinion regarding <br />the interpretation of the provisions of Article XIV, <br />Section 29 of the Charter, and, <br /> <br /> WHEREAS~ It is essential that such question be <br />clarified at the earliest possible time, and, <br /> <br /> WHEREAS, This resolution constitutes an emergency <br />measure providing for the irmmediate preservation of the <br />public property and for the usual daily operation of a <br />municipal department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby <br />authorized and directed to engage the firm of Squire, <br />Sanders and Dempsey to prosecute an action in declaratory <br />judgraent for an interpretation of the provisionsof Article XIV, <br />Section 29 of the Charter of the City of Lakewood. <br /> <br /> Section 2. That this resolution is hereby declared <br />to be an emergency measure for the reasons stated in the <br />preamble hereof and provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and <br />approval by the Mayor. <br /> <br />Adopted: February 19, 1962 <br /> <br />Robert M.
