RESOLUTION NO; 4189 BY: Messrs. Wendling, Williamson, <br /> Gaydos, Huffman, <br /> Lawther, Usher. <br /> AN EMERGENCY RESOLUTION authorizing and directing the <br />Finance Director of the City of Lakewood to accept the principal <br />and interest on special assessment levied on permanent parcel <br />number 313-22-86 on the Cuyahoga County Auditor,s records and <br />authorizing the County Auditor to cancel said special assessment <br />for the year 1963. <br /> <br /> WHEREAS, the City has special assessments charged against <br />the property hereinafter described and levied under Ordinance <br />No. 61-57, adopted by the Council of the City of Lakewood on <br />July 1~ 1957~ and, <br /> <br /> WHEREAS, The owner of the said property has tendered pay, <br />ment of the principal portion and interest on the special assess- <br />mentS levied on said parcel pursuant to the provisions of Section <br />5719.16 of the Revised Code of the State of 0hio~ and, <br /> <br /> WHEREAS, This resolution constitutes an emergency measure <br />providing for the usual daily operation of a municipal depart- <br />ment; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEW00D, <br />STATE OF OHIO: <br /> <br /> Section 1o That the Director of Finance of the City of <br />Lakewood be and he is hereby authorized and directed to accept <br />the sum of $15.90 tendered in payment of the principal and inter- <br />est for the year 1963 of special sssessment charged against the <br />property described as permanent parcel number 313-22-86 on the <br />Auditor,s records of Cuyahoga County, Ohio, and levied under <br />Ordinance No. 61-57, adopted by the Council of the City of <br />Lakewood on July 1~ 1957. <br /> <br /> Section 2. That said special assessment as hereinbefore <br />set forth having been accepted as set f ~ <br /> .oroh in Section 1 hereof, <br />and the Auditor of Cuyahoga County be and he is hereby author- <br />ized to cance$ said special assessment for the year 1963 levied <br />under Ordinance No. 61-57, adopted by the Council of the City <br />of Lakewood on July 1, 1957 on permanent parcel number 313-22-86 <br />on the County Auditor's records and further described as being <br />Sublot number 126 in the W. A. Kurz Company Subdivision, each <br />annual assessment being in the amount of $15.90. <br /> <br /> Section 3. That the Clerk of Council be and he is hereby <br />authorized and directed to deliver a certified copy of this reso- <br />lution to the Auditor of Cuyahoga County for the purpose of hav- <br />ing said special assessment cancelled. <br /> <br /> Section 4. That this resolution is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect <br />and be in force immediately upon its adoption and approval by <br />the Mayor. <br /> <br />Adopted: December 17, 1962 <br /> <br />Robert M. <br /> <br />Lawther <br /> Presiden~ <br /> <br />Approved:......December 26, 1~62 <br /> <br />Philip M.
